When Enough Is Enough: Resisting Upselling

By Regina Schrambling Last night I realized there’s one more good reason to become a regular at a restaurant. It makes it so much easier, not to mention more dignified, to resist the inevitable upselling. This was at a newish, constantly packed place we’ve managed to get into four or five times, and we were with friends on their maiden voyage through the menu. My consort knew to take charge of the wine and order the cheaper big-A carafe of rosé because we might want a second, sitting out there on the sidewalk in the setting sun. So when the very charming waiter instead recommended the Provencal that “most people seem to prefer” over the just-okay New York State one we’d chosen, he said thanks but no thanks. Not for 20 bucks more. And it was the same after we’d ordered our main courses. The very charming waiter was very persuasive that we should add some garlic spinach or crushed Brussels sprouts or Mexican corn off the cob. But I intervened to say there would be more than enough food on our plates as it was. Every time we’ve eaten there we’ve come home with a heavy kittybag. (My two fat fillets of trout Milanese were layered over fingerlings, fried artichokes, pickled onions and aioli for all of $25.) Given how generous the affordable portions are, it makes sense that the place makes its money with the add-ons. Especially given that most patrons probably go there for the oldest reason in the restaurant profession: Location, location, location (near Lincoln Center). So I didn’t mind a practice that’s normally annoying. And I definitely didn’t blame that very charming waiter. He was only doing his job, and well. It’s just that a little knowledge is not always a dangerous thing.

As ACA Implementation Continues, Consumer Health Care Cost Growth Has Slowed

Prices for personal consumption expenditures (PCE) on health care goods and services rose just 1.1 percent over the twelve months ending in May 2013, the slowest rate of increase in nearly 50 years. The slowdown in PCE health care inflation has been widespread, with important contributions from two large components: hospital and nursing home services (which comprise 42 percent of total health care expenditures) and outpatient services (which comprise 34 percent of total health care expenditures). As the chart below shows, since March 2010, these two components of health spending have made notably smaller contributions to overall consumer health care inflation than in previous years.

The slowdown in consumer health care price inflation is consistent with a broad array of other evidence suggesting that the growth rate of health care costs is slowing:

  • Data from the Bureau of Labor Statistics’ Employer Costs for Employee Compensation survey indicate that for private sector employers offering health insurance, the annualized growth rate of real (inflation-adjusted) costs for workers’ health insurance has slowed from 2.2 percent a year from 2006:Q4 to 2009:Q4 to 1.8 percent a year from 2009:Q4 to 2012:Q4, with a particularly marked slowdown occurring at smaller establishments. For establishments with fewer than 50 employees, employers’ real costs for workers’ health insurance grew just 1.0 percent a year from 2009:Q4 to 2012:Q4, half the rate observed over the preceding three years.
  • During the past several years, the Congressional Budget Office reports that it “has made a series of downward adjustments to its projections of spending for Medicaid and Medicare.” For example, “mostly reflecting the slower growth in the programs’ spending in recent years,” CBO now expects combined spending on the two programs to be about $200 billion lower in 2020 than what it forecast three years ago.
  • From 2009 to 2011, nationwide real per capita health expenditures grew at the slowest pace since reporting began in 1960.
  • In 2012, premium growth for employer-sponsored insurance was at its lowest rate (3 percent) since the Medical Expenditure Panel Survey started in 1996.

  • In 13 states that have publicly reported premiums for 2014, the average of the lowest-cost plan is nearly 20 percent below projections based on CBO premiums. This includes New York State, which recently announced that health insurance rates in 2014 will be at least 50 percent lower, on average, than the plans currently available in the state. These substantially more affordable plans will soon be available through the new Health Insurance Marketplace established by the Affordable Care Act.

MR. CARNEY: Good afternoon, everyone. Thanks for being here. I apologize for the slight delay. I was just rereading, for the pure enjoyment the article above the fold in The New York Times today about projected decline in health care premiums. (Laughter.) Highly recommend it.

Before I take your questions, on Thursday the President will deliver remarks to discuss how the Affordable Care Act is holding insurance companies accountable and putting money back into the pockets of over 8.5 million Americans. We hear a lot about what the law might do or could do, but tomorrow the President will detail one concrete way that Americans who have health insurance today are affected by the law.

This summer 8.5 million consumers are receiving half a billion dollars in rebates. The average consumer rebate is around $100. This is just one of the many ways the Affordable Care Act is giving consumers a better value for their health care dollar and making our health care system stronger.

As I mentioned earlier, you may have seen this morning that New York State announced the health insurance plan rates for insurers seeking to offer coverage through New York’s health insurance marketplace. Not only will new insurers be entering the market to offer plans to consumers, the cost for even the most comprehensive plans will be down by over 50 percent, according to the state. This is despite the fact that New York’s health care costs are much higher than the national average.

But this is in line with what we’ve seen in other states, like California and Oregon. Competition and transparency in the marketplaces, plus the hard effort by those committed to making the law work, are leading to affordable, new, and better choices for families.

I noticed in that article that, for example, an individual whose premium this year is $1,000 might see his or her premium drop in New York next year to $308. There is a particular poignancy to this story today, because for the 38th, 39th, 40th time — I’ve lost count; I think they have, too — the House of Representatives will be voting to repeal the Affordable Care Act today.

In other words, they’ll be voting, through their measure to delay implementation of the individual mandate, to keep those rates at $1,000 for the individual in New York, rather than $308, to ensure that everyone out there who worries about whether they have or a family member has a preexisting condition, and whether or not they’ll get health insurance coverage, will continue to worry. That worry doesn’t exist now because of the Affordable Care Act, but if Republicans in the House had their way, Americans could worry again about that prospect.

So they go about the business, again, of trying to overturn a law that is providing enormous benefits, and as we’ve seen again, will provide even more benefits to the …read more

N.Y. State Could Get $40 Million From Man Who Died Without A Will

Nearly 2.5 million Americans died last year, many without signing a will. One of them was apparently Roman Blum, a Holocaust survivor and New York real estate developer who was worth almost $40 million when he passed away in January 2012 at the age of 97. A worldwide search for heirs since then hasn’t turned up any living relatives. If, after three years, there’s still no sign of his doing any estate planning and no one comes forward to claim his assets, all that money will go to New York State, under a legal rule called escheat.

Open Letter to Travel Media: Brooklyn Is Not A City

Right now, there is little doubt that Brooklyn, one of five boroughs compromising New York City, a city located within New York State, which in turn is part of the United States of America, is the next big thing. I added the detailed geopolitical clarification for the sake of my many brethren in the food and travel media sector who can’t seem to come to come to terms with what or where Brooklyn actually is.

New York Revolution: Stopping The Cuomo Gun Grab

In January of 2013, Gov. Andrew Cuomo announced that he would push for the most comprehensive firearms ban in the United States. His objectives or reasoning were unclear at the time other then the fact that he is a progressive; and we all know that progressives hate firearms, always have, and always will.

Because of the fact that the majority of our elected officials have been complacent and apathetic, the majority of the citizens of New York State have been as well. The New York SAFE Act was an easy slam dunk for Cuomo. The legislation was hastily written and forced onto the state Senate and Assembly on the first day of the new term. Not only was there not any time granted for review of the bill; no time was allowed for debate. The bill was forced to a vote in the dead of night. This was clearly a three-man backroom deal between Cuomo and the majority leaders, the type of deal that the corrupt New York State government is so accustomed to.

After seeing how fast this piece of draconian legislation was forced upon the residents of New York, a man named George Curbelo decided to try and make a difference; and so New York Revolution was born. New York Revolution is by no means one man’s attempt at starting a militia group; as we all know, such groups are illegal in New York State. Instead, this group was started with the goal of educating citizens and to get them to re-engage in the day-to-day affairs of state government (starting with the direct assault on our Second Amendment rights.)

New York State residents can no longer sit on the fence and rely on the elected officials of the state to take care of things. We have seen how well that worked out. New York Revolution has been designed so people can interact via social networking and community organizing. County leaders have been chosen in at least 31 counties to date, including New York City. Countywide rallies are being held as often as possible in order to get people to stand up for their rights and become informed.  Five such rallies were held across New York on April 13th; and many were attended by US Congressman Chris Gibson and one by NYS Assemblyman Peter Lopez, as well as county and town leaders and Sheriffs.

New York Revolution has realized that if our Second Amendment falls, the rest will soon follow. So if New York residents want to continue to have a voice, find your voice and get involved. Rights are already being taken away at an alarming rate in New York City by a progressive mayor, and the disease is creeping north. Take your stand today and become part of the solution. Educate yourself, and “We the People” together can stop the trampling of our Constitutional rights. As always, stay safe and be aware of your surroundings.

More Dishonest Coverage From Pro-Homosexual Media

A big news story came out of last Tuesday’s March for Marriage demonstration in Washington, D.C. But it didn’t make “news” in the major media. As one who covered the event, it was significant that there were so many members of minority groups. This was not a mostly white crowd. In addition to the presence of black, Hispanic, and Asian supporters of traditional marriage, there were some notable Democrats, such as New York State Senator Ruben Díaz; and he let people know he was several minorities in one.

“I’m Puerto Rican,” he said. “I’m black, with kinky hair. I am a Democrat, and I am a senator. I’m against abortion. I’m against same-sex marriage, and I won the last election with 89 percent of the vote.”

J.C. Derrick of World Magazine has a good analysis of how the major media, led by The Washington Post, virtually ignored the March for Marriage. But unless you actually see what happened on the ground, as the thousands of traditional marriage supporters held their demonstration, you would miss the true significance of how dishonest the media’s coverage of this issue has become.

The March for Marriage went by the Supreme Court before returning to the National Mall location where the rally was held. The group has posted a video of excerpts of the major speeches.

Ken McIntyre of the Heritage Foundation wrote a dispatch, with pictures: Marching for Marriage—and Children. John Burger of the Catholic World Report estimated the crowd at 10,000. Based on attendance at several rallies in the nation’s capital, I put the crowd size at about 5,000.

Díaz, the New York state senator, led an all-night vigil for the rally of 32 buses filled with Pentecostal ministers and members of the New York Hispanic Clergy Organization.

He was the only Democratic state senator in 2011 to cast a “No” vote on the homosexual marriage bill in New York State, and he was the only lawmaker to rise to speak against it. “God, not Albany, has settled the definition of marriage, a long time ago,” Díaz said.

The video excerpts are interesting, in that a self-proclaimed homosexual man (Doug Mainwaring, co-founder of the National Capital Tea Party Patriots) was also shown opposing homosexual marriage.

He spoke at a Heritage Foundation event, saying, “I used to be pro-same-sex marriage but the more I thought about it, it occurred to me, this just isn’t right. Marriage is the most successful institution that civilization has produced over the last few millennia, and we shouldn’t mess with it. If we attempt to redefine marriage, we’re going to redefine children in the same way. In fact, I prefer to use the term ‘undefine.’”

His speech at the March for Marriage included the admonition that the Supreme Court should “ignore the media’s relentless, manufactured urgency to institute same-sex marriage.”

Methane Emissions From Fracking Face Increased Scrutiny With New Baseline Testing

Anti-fracking activists in New York State have conducted one of the first methane baseline assessments on an area that will soon be home to a natural gas compressor station. It’s hoped that by establishing a baseline measurement of ambient methane, residents will be able to prove fracking’s negative effects on air and water.

All drinking water is contaminated, but one thing it shouldn’t be is flammable. Unfortunately that’s often exactly what happens when Big Gas comes to town. Gas companies deny culpability by claiming that high levels of methane were present before they arrived. The baseline test, conducted by GasSafetyUSA in conjunction with Damascus Citizens for Sustainability, hopes to expose fracking’s true impact.

Did Obama Buy Trouble Shopping for a Budget Chief at Walmart?

President Obama announced Monday morning that he had nominated Walmart Foundation president Sylvia Matthews Burwell to be his new director of the Office of Management and Budget.

Burwell, who previously headed the Global Development Program at the Bill and Melinda Gates Foundation, came to the Walmart (WMT) Foundation in 2011. As head of the retailer’s charity arm, Burwell was in charge of directing targeted giving campaigns to a wide range of charities and nonprofits.

Walmart and Obama seem like an unlikely pairing, given that the company isn’t exactly a favorite of the left. But as we’ve previously reported, Walmart has teamed up with the first lady by supporting two of her biggest initiative: hiring veterans and encouraging healthy eating. While we’ve suggested that the relationship with Michelle Obama was more about public relations than politics, the company is now poised to take that relationship to the next level by getting an executive into the president’s cabinet.

That wouldn’t be much of an issue if Burwell’s job had been simply using Walmart’s money to give back to the community, but The Nation has an in-depth look at how this “targeted giving” often coincided with the company’s larger goals. For instance, in 2011 the Foundation gave a $200,000 grant to the NAACP; the organization’s New York State chapter now says it supports Walmart stores coming to New York City. (A spokesperson for the group denied that the donation played a part in its support of Walmart’s bid to build stores in the city.)

The story also observes that the Walmart Foundation regularly gave money to communities where the company has a presence or was planning to expand, including a few where the retailer was embroiled in political fights over expansion and zoning issues. And it also links those charitable endeavors to its larger efforts to influence “elected officials” in key markets.

If Burwell is confirmed by the Senate, she’ll have access to the biggest elected official of them all.

Being a resident of New York state all of my life, I have seen my share of corrupt, liberal governors from Rockefeller (who died while in the company of a prostitute) to Elliot Spitzer and his client number nine moment to the abject failure of David Patterson. But, this time around, we now have the smooth and crass Andrew Cuomo.

Cuomo, when asked to run for Governor by the Democrat party, seemed very reluctant to give up his post as New York State attorney general. But in the end, he decided to run against Tea Party candidate Carl Palidino. It was a grueling campaign; and as usual, the Democrats pulled out all of the stops right down to going after Carl’s family. The tide turned on the election when Carl was nearly engaged in a physical altercation with journalist Fred Dicker over his children being exploited. Ultimately, Carl was then framed as a hothead for doing what any father would do to protect his children. Well, we ended up with Cuomo.

Upon Cuomo’s arrival in Albany, he came across as very fiscally conservative (for a liberal, that is), engaging in a fight with the public sector unions in order to reduce their impact on the New York economy. He also pushed for a two percent tax cap on all local budgets. These things made him look more like a moderate, and people were starting to warm up to him. Up until his draconian New York Safe Act gun law, he enjoyed an approval rating of 73 percent. Since that time, he still enjoys a 59 percent approval rating.

Now, he is saying that amendments will be made to the Safe Act. Such as, removing the restrictions on police officers as to magazine sizes and bullet quantities. I believe that while these amendments are done, he may try to sneak a version of AO 3908, the assembly bill requiring that firearms owners purchase 1 million dollars of liability insurance, into law.

Now, a history lesson on Cuomo. Before he was the attorney general for New York, he served as the Housing and Urban Development secretary under Bill Clinton. As HUD secretary, he was responsible for pushing the banks to give mortgages out to low income people, whom they knew could not afford to pay them back. I hold Cuomo partially responsible for not only the banking, but also the housing crises that put America into her downward spiral. Now why would he have done this, you ask? Because Andrew Cuomo has been instrumental in implementing the UN’s Agenda 21, right after Clinton signed the executive order on “sustainable development”. Cuomo is a key player in this.

Agenda 21 is the UN plan to turn ALL private property over to the government sector, thus creating a loss of US sovereignty. What better way to do this than to sell private homes to people who can’t afford them and to have the mortgages guaranteed by Fannie Mae and Freddie Mac, 2 government insurers who refuse to be audited? …read more

NEW YORK, Feb 21 (Reuters) – New York State has told its financial watchdog to investigate three insurance companies for dragging their heels when it comes to processing claims for damage caused by Superstorm Sandy that slammed the region last October.
New York State Governor Andrew Cuomo said in a statement that consumer complaints against Narragansett Bay Insurance Company, Tower Insurance Company and Kingstone Insurance Company received by the state’s Department of Financial Services have been “much higher than average.”
“We have been working with the insurance industry to streamline the rules and thank the companies who have responded,” Cuomo said in the statement. “But we won’t tolerate insurers not doing what homeowners paid them to do.”
The insurance companies are being investigated for not sending adjusters or processing claims quickly enough, and not making their representatives available to homeowners, the statement said.
The storm caused around $40 billion of damage in New York State. Loss of property tax revenues, emergency funds, and hefty repair bills have put an additional strain on the stretched municipal finances throughout the state, despite aid from the federal government.
The statement said that policyholders of Narragansett Bay, which is backed by billionaire financier George Soros, complained they could not reach adjusters or that adjusters did not arrive for scheduled appointments.
Complaints against Tower Insurance, whose parent company is Nasdaq listed Tower Group Inc, suggested the company regularly failed to send adjusters to inspect damage, denied claims over the telephone without an adjuster visit, and delayed other claims without justification.
The statement said complaints against Kingstone centered on the company’s failure to send adjusters, and failing to conduct comprehensive inspections. The company also denied wind damage claims, disputed settlement amounts, and delayed settlement, according to complaints.
None of the three insurance companies could be immediately reached for comment.
