Race not driving Chicago public school closures, officials say

Officials at the nation’s third largest school district defended the closure of some 50 Chicago public schools, telling a federal court on Thursday that budgetary issues and the underuse of many buildings — not race — drove decisions about which schools to shutter.

The testimony came as Chicago Public Schools sought to persuade a judge not to issue an injunction halting the plan. The Chicago Teachers Union and parents pushing for the injunction before the new school year begins say the closures inordinately harm black and special-needs kids, violating their rights.

The hearing — in its third day on Thursday — stems from several lawsuits filed on behalf of parents. One contends black children make up about 88 percent of students being moved from closed schools, although they comprise 42 percent of district students.

On the stand Thursday, Chicago Public Schools’ budget director, Ginger Ostro, told U.S. District Judge Judge John Z. Lee that a $1 billion deficit in the next fiscal year loomed over the district as it thought through its closing plans, which were approved in May.

The closings would save $40 million, which would then be kicked into improving education for displaced students at their new schools. The district would spend tens of million more on schools taking those students, Ostro said.

Critics say talk by city and schools officials of budgetary savings is misleading, leaving the impression that the closures will help address the yawning budget deficit. Pressed under cross-examination Thursday, Ostro conceded the closures weren’t designed to fix CPS’ financial mess.

“It’s not primarily a budget-deficit initiative,” she said about the closings. Instead, the aim was to “better focus our resources rather than spread them thinly across.”

Later Thursday, the district announced that it was laying off 2,113 teachers and support staff. It attributed the action to the failure of the Legislature to reach a deal on pension reform.

Adam Anderson, a Chicago Public Schools planning official, testified earlier Thursday that what guided the district as it decided what schools would be closed was how much classroom space wasn’t being used.

A complex “utilization equation” was employed in the process, and the district found there were some 500,000 available classroom seats for 400,000 students, leaving 100,000 seats unused, Anderson said.

Enrollment has fallen over the years with a corresponding fall in population in African-American areas, which is why so many of the schools that ended up on the closure list were in predominantly black neighborhoods, Anderson said.

One of the lawsuits, however, argues the consequences have a racial element, saying “white children … have been almost universally insulated from the negative educational consequences of school closings.”

Also Thursday, the head of security for CPS, Jadine Chou, told the court the district is implementing measures to ensure street gangs don’t pose a threat to students attending new schools. Opponents of the closures say those students may end up stepping into the line of fire of warring gangs as they walk through unfamiliar neighborhoods.

Texas authorities investigate death of baby scalded with hot water

Police in Texas are investigating the death of an 10-month old baby boy who died from injuries after being scalded with hot water, MyFoxHouston.com reports.

A police spokesman tells Fox 26 the boy died from his injuries after being taken to Bayshore hospital by his parents Wednesday afternoon.

“Eventually we knew something was going to happen,” said neighbor Kathy Bouware. She says although sad, she wasn’t surprised by what happened.

According to the boy’s grandparents, who refused to talk on camera, it wasn’t the first time the child had been taken to the hospital.

They say in August, CPS removed the child from the home after he was injured.

CPS should’ve never given that baby back to them,” said Bouware. She says the boy’s father, Will Cain, is known for his anger.

“He would be out here on the street causing problems with the neighbors and things and just acting real bizarre,” said Bouware.

Pasadena police say it’s a rare case, because neither parent is willing to speak to investigators. The family has hired a lawyer.

The family attorney gave no comment regarding the case.

Late Wednesday, Pasadena police executed a search warrant of the home. No charges have been filed at this time.

Police cite 127 protesters rallying against proposed closure of Chicago schools

Police arrested more than 100 protesters who staged a sit-in in front of Chicago’s city hall on Wednesday to demonstrate against the proposed closing of 54 public schools, MyFoxChicago.com reports.

The protest reportedly shut down some streets at the height of rush-hour traffic.

“This is the largest single closing in history of any city in this country,” says Tom Balanoff, president of Service Employees International Union, Local 1. “This is a massive city. It’s going to put our children in danger and it’s not necessary!”

About 127 of the protesters, including many Chicago Public Schools employees, were cited and released.

The large crowd reportedly cheered as each protester was arrested and led away to a holding area across the street.

“I feel elated for a good cause,” CPS paraprofessional Adeline Bracey said. “Someone needs to stand up to this administration and tell them we will not go quiet into the night.”

“My mother was a public school teacher, my kids go to public schools, I marched with them,” said a University of Illinois-Champaign professor. “I think [the] mayor is destroying the city.”

Patrick Calihan collected each citation. He is an attorney hired by the CTU and SEIU to represent the protesters’ in court.

“We notified the city and department of what we’d be doing and they were very, how can I say, understanding about what we have to do to exercise free speech,” Calihan said.

Each protester will have to pay a fine ranging from $45 to $100 depending on what the attorney works out with the court.

Protesters march against Chicago school closures

Hundreds of teachers, parents and opponents have marched through downtown Chicago, vowing to fight a plan to close 54 Chicago Public Schools.

Wednesday’s march came as Mayor Rahm Emanuel‘s insisted he’s done negotiating and the closures are a done deal.

Emanuel and schools chief Barbara Byrd-Bennett say closures in the nation’s third-largest district are necessary because CPS faces a $1 billion budget shortfall and has too many schools that are half-empty and failing academically.

The closures are expected to save $560 million over 10 years in capital costs and $43 million per year in operating costs. About 30,000 students would be affected.

Chicago Teachers Union President Karen Lewis called the closings “injustices” and said lawsuits are planned.

The closures would take effect at the start of the 2013-2014 school year.

Why would the Chicago Public School (CPS) system be so presumptuous as to start teaching Lesbian, Gay, Bi-sexual, and Transsexual Sex-Ed to all its students, even five year old kindergarteners? Aside from pure hubris, satisfying Gay political groups is a good guess; but the simple answer is because they can. The Chicago’s public schools are more than 85% black or Latino and just 8.8% white. A combined 87% of black and Hispanic Chicagoans live in poverty, so they are as dependent upon white liberals as house pets are to their owners.

If these numbers were reversed, the White ruling class in Chicago wouldn’t dare force this plan on its students; yet because they own Chicago’s minorities, they can treat them like house pets. It makes no difference what the conditions of the schools in Chicago are, or that they don’t teach their students basic skills. The White liberal ruling class tells its subjects where to live, what schools to attend, what will be taught, which stores they are allowed to shop in, and on and on.

Now Chicago’s White ruling class has decided bowing to Gay groups is more important than the innocence of its five year olds. There seems to have been no public hearings on this policy. There were no parents’ statements entered into the record about the plan. There was no discussion of how 5 year old kindergarten children would be affected by having their innocence wrenched away. Nobody asked how a child being taught the differences between normal sexuality and homosexuality was supposed to continue to believe in Santa Claus or the doctrines of his or her family religion. None of Chicago’s subjects was given a chance to ask CPS administrators if they were concerned about having teachers instruct grade school children about “Kama Sutra” positions. Was anyone concerned that homosexual teachers presenting LGBT material to five year olds is an ugly intrusion of the rights of parents?

Of course, the CPS uses the standard liberal excuse that the plan includes an “Opt out clause.” What about an affirmative “Opt in” clause? Oh, that might draw too little interest and force teachers to actually attempt to teach.

Police Dog’s Hilarious ‘Witness Statement’ To English Prosecutors Gets UK Cops In Trouble (PHOTO)

It’s a dog eat dog world, and officials in England apparently have trouble telling dogs and humans apart.

England‘s Crown Prosecution Service (CPS) barked up the wrong tree earlier this month when they requested a witness statement from a “PC Peach,” not realizing PD Peach was actually the police dog at the scene — not an officer.

Officers at the West Midland Police station attempted to correct CPS, informing them Peach was a canine, “to no avail,” the Telegraph reports. So in an act of mischief, they went ahead and completed a witness statement from “PC Peach,” then displayed it on one of the station’s walls for the amusement of their colleagues.

Russians investigating adoptee's death in Texas

Authorities in Russia say they want to know how a toddler adopted by an American family died in West Texas.

Russia‘s Investigative Committee said Monday that it had opened an investigation into the Jan. 21 death of 3-year-old Maxim Kuzmin. The committee says it has information the boy was mistreated.

Texas Child Protective Services confirmed Monday that Ector County Sheriff’s Department is investigating the death of 3-year-old named Max Shatto.

Sheriff’s Department spokesman Sgt. Gary Duesler says an autopsy is pending on a 3-year-old boy who was adopted from Russia. CPS spokesman Patrick Crimmins said the agency was investigating allegations of physical abuse and neglect. No arrests have been made.

Russian authorities recently banned American adoptions. They say the boy’s case is another example of “inhuman treatment” by American parents.

Texas couple with 2 kids on old bus makes progress

Home for a Southeast Texas family is still an old school bus with no engine and no front wheels.

But child welfare officials are delighted with the commitment the parents have shown since their two young kids were discovered living there virtually unsupervised almost a year ago while their father and mother were in federal prison.

Child Protective Services officials are expected to recommend a judge dismiss the welfare agency’s case against Mark and Sherrie Shorten in court Tuesday, allowing the couple to regain full custody of their 12-year-old daughter and 6-year-old son.

“That’s what I’ve been targeting all along,” Mark Shorten said.

The children are in school and the parents have complied with CPS care plans, evaluations and therapy, agency spokeswoman Gwen Carter said.

“They’re doing really well and the family is doing really well,” she said. “The staff is very proud of them.”

Last March, a postal worker, after repeatedly spotting two disheveled children in the Montgomery County neighborhood about 35 miles northeast of Houston, became concerned and notified authorities. Welfare officials quickly arrived and placed the kids in foster care while media coverage led with images of the outwardly dilapidated bus on a trash-littered lot.

Carter said officials are accustomed to poor families living in tough conditions and while it’s not illegal to live in a bus, “sadly, that was the sensational part, the condition of their living environment and they were left there all day.”

“Let’s be blunt,” Mark Shorten said. “Once I saw pictures on the news and read the full story, I was glad somebody pulled my children out of that mess. Both of them suffered through that mess.”

At the time, Shorten and his wife were in separate federal prisons both serving 18 months for convictions for conspiracy to embezzle money from victims of Hurricane Ike, which struck in 2008. They had arranged for their children to be supervised by an aunt, who told authorities she became overwhelmed between working 12-hour days and trying to care for them.

“There was a lot of emotional and mental anguish put on the kids,” said Sherrie Shorten, who was released from prison several weeks after the children were removed. “And that’s what we were upset about.”

Her husband was released in July and their children were returned to them, under CPS supervision, in September.

“My main focus when I got home was getting my kids back home,” Mark Shorten said. “And I did that. Life’s as good as it’s going to get at the moment but we’re trying to make it better.”

Despite its worn appearance, the bus inside had been renovated, furnished, had hot and cold water and a bathroom, and was air-conditioned. The family moved it from Louisiana after their home there was flooded from Hurricane Ike. It was intended as a temporary home until they could build on the lot, where the trash has been cleared and items outside, like a lumber pile, are neatly stacked.

“We’d still like to (build), but we have some restrictions,” said Sherrie Shorten, who with her husband is on supervised federal release for three years and also looking at more than $100,000 in court-ordered restitution. “We have a lot of issues rebuilding our lives and getting back on track.”

Mark Shorten maintains neither he nor his wife, an accountant, were guilty.

“I don’t want to sound like somebody who is bitter and mad, because I’m not,” he said. “We’re trying to move forward.”

Kidnapped Texas boy taken as infant goes to live with 4 siblings

Miguel Morin arrived at his new home in suburban Houston on Friday to four pizzas and a group of siblings eager to accept them into their family years after he was snatched from his parents’ home as an infant.

Miguel, now 8 years old, was able to move permanently into the home of Junita and Joseph Auguillard thanks to a judge’s ruling Wednesday. The home isn’t unfamiliar to him. Miguel, who’s been in foster care since he was found in March, has been spending weekends and holidays there since November, and the Auguillards are the legal guardians of his two sisters and two brothers.

“This is what we’ve been waiting for. It’s been a long time coming, but it’s finally here,” the soft-spoken Joseph Auguillard said as he waited for a caseworker from Texas Child and Protective Services to drop Miguel off for the last time.

Miguel was kidnapped when he was 8 months old. Miguel’s former baby sitter, Krystle Tanner, and her mother, Gloria Walker, have been charged with kidnapping and injury to a child in his 2004 disappearance. They have pleaded not guilty and remain in jail.

Morin is moving into the Auguillard’s small, single-family home in Channelview, a town about 16 miles east of Houston. He joins his brothers and sisters, as well as eight of the Auguillard’s own children.

Ranging in age from 7 to 19, the children all embraced Miguel immediately, Junita Auguillard said, standing in a small living room that has family pictures hanging on the walls and sitting on a brick fireplace.

“He fit right in, like he was never supposed to be gone,” said Junita Auguillard, who knew Miguel as a baby before he was kidnapped. “He had an instant bond with the other siblings.”

The Auguillards have been taking care of Miguel’s brothers and sisters for nearly 10 years, Junita Auguillard said. Miguel’s parents, Auboni Champion-Morin and Fernando Morin, were the Auguillards’ neighbors in a previous apartment complex. Initially, they had asked the Auguillards to care for their two oldest children, now 14 and 12, for a year until they “got settled,” she said. But then they gave them guardianship of their two younger children, now 10 and 7, she said.

It remains unclear why the Morins did not want to care for their children, Auguillard said. They rarely visit, and only occasionally call, she said. The judge had also said Miguel’s parents could visit him in the Auguillards’ home, she said, however, they have not since his visits began in November.

Miguel and his biological parents are undergoing therapy together, and CPS hopes they will one day share custody with the Auguillards.

For now, though, the Auguillards are simply happy Miguel will no longer have to return to foster care.

“I just hate to see him cry because every time we bring him back he’d cry in the car,” Auguillard said.

Report details depths of BBC monster's child sex assaults

The sickening trail of sex abuse left by the late BBC television star Jimmy Savile spanned six decades and included more than 400 victims, many of them very young children, British authorities said.

The creepy TV presenter, unknown in the U.S. but a massive star in the United Kingdom, died in 2011 at age 84, before his crimes surfaced. The revelations have stunned the nation and prompted accusations the venerable BBC willfully ignored a monster in its midst, but a new report shows Savile’s crimes were even worse than previously suspected.

“He spent every minute of every waking day thinking about it. Whenever an opportunity came along he has taken it,” said Detective Superintendent David Gray, the leading investigator. “He [was] programmed to think and act in that way. He only picked the most vulnerable, the ones least likely to speak out against him.”

The official report from the Metropolitan Police and the National Society for the Prevention of Cruelty to Children found Savile committed an “unprecedented” level of abuse against as many as 450 victims.

“Savile’s offending footprint was vast, predatory and opportunistic,” Commander Peter Spindler, head of the police department’s Specialist Crime Investigations unit, told reporters.

An estimated 34 of the victims were raped, including 26 females and eight males. Most of his victims were ages 13 to 16, and a “significant number” of Savile’s victims have been identified, according to the report.

The report suggests that part of the reason Savile was never caught was because at the time he was most active “police investigation of such crimes was more basic and lacked the specialist skills, knowledge and the collaborative approach of later years.”

The report found that many of the attacks occurred inside BBC buildings, including the complex where Savile’s show, “Jim’ll Fix It,” was filmed. The report chronicled a pattern of abuse that may have begun in the 1950s. One early attack came in 1960, when Savile took a 10-year-old autograph seeker into his hotel and sexually assaulted him, the report said.

The last attack allegedly came in 2009, when the then-80-year-old Savile put his hand up the skirt of 43-year-old woman aboard a train, according to the report.

Spindler said Savile chose “the most vulnerable who were least likely to speak out against him.”

He attacked victims in BBC studios and offices, a camper he kept parked at the network’s facilities, hotels and even hospitals, according to the report. Savile used his celebrity status to prey on children who wrote letters to him and ones he met while visiting schools, according to the report.

The report branded him one of Britain’s worst “predatory sex offenders,” but the document raises huge questions about why he was never caught by police in his lifetime.

Director of Public Prosecutions Keir Starmer said: “I would like to take the opportunity to apologize for the shortcomings in the part played by the CPS in these cases.

“If this report and my apology are to serve their full purpose, then this must be seen as a watershed moment.”

The BBC said it was “appalled” that some of the offences “were committed on its premises,” adding that it “would like to restate our sincere apology to the victims of these crimes.”

Peter Watt, NSPCC Director of Child Protection Advice and Awareness, who co-authored the report with Gray, said that the scale of Savile’s abuse “simply beggared belief.”

“Savile was without doubt one of the most prolific sex offenders we have ever come across,” he said.

Police finally got onto Savile’s trail of abuse when Surrey Police received an allegation in May 2007 that he had sexually assaulted a teenage girl at Duncroft Children’s Home in the late 1970s. That investigation led to other allegations and a national clearinghouse for tips began to explode with new accusations.
