University condemns court ban of research paper on flaws in car lock system

A court ban on a research paper that analyzes flaws in a car-lock system should be overturned, according to the Dutch university that employs two of the three researchers who wrote the analysis.

The U.K. High Court of Justice banned the publication of the paper, “Dismantling Megamos Crypto: Wirelessly Lockpicking a Vehicle Immobilizer” on June 25, said the Radboud University Nijmegen in a news release on Monday. The ban came to the attention of the public when the U.K. newspaper The Guardian published a story about it over the weekend.

The U.K. court issued an interim block on the research paper, while considering a permanent ban on request of car manufacturer Volkswagen, the university added. French defence group Thales also requested the ban, according to a report by the BBC.

Roel Verdult and Baris Ege, of the Digital Security faculty at Radboud University, were planning to present their paper with Flavio Garcia a lecturer in Computer Science of the University of Birmingham during the USENIX Security Symposium in Washington, D.C., in August, the Dutch university said.

High Court 'pardon' bid for Boer war soldier 'Breaker' Morant

His death in front of a firing squad was the defining moment of one of the best known, and most bitter, episodes of the Boer War: British-Australian soldier Harry “Breaker” Morant was court martialled and sentenced to death in 1902 for shooting prisoners.

But now, more than a century on, campaigners are to launch a legal bid at the High Court in London to force the Government to open an inquiry into the case with a view to securing a posthumous pardon for Morant, as well as fellow soldiers, Peter Handcock, shot for the same offence, and George Witton, who was jailed for life.

The supporters believe the men were simply following British army orders when they executed their prisoners and that they were used as scapegoats by embarrassed senior officers, including Lord Kitchener, and to accelerate peace talks with the Boers.

Jim Unkles, a military lawyer who has taken the case on, said: “I am applying to the High Court for a review of the British government decision not to help an independent inquiry. I am filing papers next month. The appeal will be on the basis that there were major errors at the court martial, that it was an abuse of protest and that these men were denied their rights. Kitchener conspired to get them executed.”…

Vatican envoy apologises to Malaysia over 'Allah' row

The Vatican’s first-ever envoy to Malaysia has apologised for supporting the use of the word “Allah” by non-Muslims after he was summoned by the foreign minister.

Archbishop Joseph Marino issued a statement late Tuesday, after meeting with Foreign Minister Anifah Aman, saying his comments were “never intended as an attempt to intrude into the internal affairs of the country”.

Marino, who arrived in Kuala Lumpur less than six months ago, had last Thursday waded into a religious row in Muslim-majority Malaysia over the use of the word “Allah”.

He described arguments put forward by the Catholic Church in an ongoing court battle for the right to translate “God” as “Allah” in Malay-language Bibles and other literature as “logical and acceptable”.

Soon after, hardline Muslim groups began calling for him to be sent home. Several cabinet ministers also accused him of “interference”.

“In that context, he asked him (Anifah) to convey apologies for any misunderstandings and inconveniences that it may have caused,” the statement said.

Anifah also said that “Archbishop Marino was advised to be mindful of the religious sensitivities of the host country and that the issue he commented on is still under the Court of Appeal”.

Controversy over the use of the word “Allah” came to a head three years ago, when the High Court ruled that non-Muslims are allowed to use the word to refer to God in their Malay-language literature.

The court case arose after Malaysia’s Catholic Church sued the government for banning the use of the word in its weekly newspaper, The Herald.

Muslims had denounced the verdict, claiming “Allah” is exclusive to Islam. The government decided to appeal the ruling after several places of worship were fire-bombed.

Malaysia has more than 2.5 million Christians in a population of 28 million, of which about 60 percent are Muslim.

Spanish PM under pressure over slush fund scandal

Spanish Prime Minister Mariano Rajoy faced calls to explain himself or resign over his alleged support for the ruling Popular Party’s disgraced former treasurer, who headed to court Monday over a slush fund scandal.

The 58-year-old, grey-bearded premier has denied any wrongdoing and refused to comment in past weeks on the growing controversy centred on former party treasurer Luis Barcenas.

Pressure on Rajoy mounted, however, as more allegations were revealed and as the 55-year-old Barcenas faced a High Court judge to answer questions over secret political payments.

Barcenas was called to appear in the Madrid court after conservative daily El Mundo last week published what it said was an original page from Barcenas’ slush fund ledger and delivered the document to the court.

The excerpt purportedly showed extra payments from a secret fund to party officials including Rajoy when he was a minister under then prime minister Jose Maria Aznar in 1997, 1998 and 1999.

Barcenas is suspected of running a slush fund financed by corporate donors who were then rewarded with public contracts. The cash was allegedly used to supplement senior party members’ salaries.

In the latest blow to Rajoy, the conservative daily El Mundo on Sunday published friendly mobile text messages between the prime minister and Barcenas from May 2011 to March 2013, ending some two months after the scandal erupted.

“Luis, I understand, be strong. I will call you tomorrow. Best wishes,” said one of the messages reportedly from Rajoy to Barcenas, dated January 18 when El Mundo first published allegations over the slush fund.

“It is not good to try to determine what we will say or to comment on things that must be presented to the courts, which we must all respect,” read another message allegedly sent by Rajoy.

Barcenas reportedly told El Mundo in an interview published July 7 that the Popular Party had engaged in illegal financing for nearly 20 years.

The Popular Party has repeatedly denied secret financing allegations.

The leader of Spain’s main opposition Socialist Party, Alfredo Perez Rubalcaba, on Sunday accused the premier of “serious collusion” with Barcenas and said he was severing all contact with the prime minister and his party.

“Given the unsustainable political situation in Spain, the Socialist Party calls for the immediate resignation of Mariano Rajoy as head of the government,” he said.

But few people in Spain expect Rajoy to step down given his party’s outright parliamentary majority.

An editorial in leading daily El Pais on Monday demanded an explanation from the premier.

“Out of respect for the democratic system, the citizens and his own party and voters, the head of government must give a true explanation to parliament,” it said.

“Otherwise it will be impossible for him to regain his credibility.”

Rajoy has so far resisted calls to appear before parliament over the scandal and has carefully avoided even mentioning the name Barcenas.

But he is expected to face the press Monday after hosting a visit by Polish Prime Minister Donald Tusk.

Blasphemy Case Finally Dismissed

ISLAMABAD, PAKISTAN (Worthy News)– The Supreme Court of Pakistan dismissed an appeal against the decision of the Islamabad High Court to revoke the First Information Report formerly lodged against Rimsha Masih under Section 295 B and C of the Pakistani Penal Code, finally putting a legal end to her controversial blasphemy case.

During the hearing, Justices Tasaduq Hussain Gillani and Nasir ul Malik dismissed the application filed by Malik Ammad to reopen the blasphemy case against Masih.

Abdul Hameed Rana, Masih's counsel, said now that the High Court has declared that Masih — a 14-year-old Christian girl who suffers from Down Syndrome — is innocent, there's no longer a case pending against her.

Masih was first arrested in the Mehrabad colony of Islamabad after Ammad had lodged a complaint with the Ramna police accusing her of burning pages of the Quran. When word of this got out, Muslim mobs attacked her home and other Christian homes in Meherabad, so the Masih family was secretly moved to an undisclosed location in Pakistan.

Masih and her family were apparently granted asylum in Canada after local Canadian news recently spotted them and then broke the story.

Pistorius brothers both due in court next week

Oscar Pistorius’ appeal against his bail conditions will be heard on Thursday, a day after the culpable homicide trial of older brother Carl begins, a family lawyer told The Associated Press on Friday.

Advocate Kenny Oldwadge said they had confirmation from Pretoria’s North Gauteng High Court that the appeal is scheduled for March 28 at the High Court, meaning the brothers will both likely have legal proceedings on the same day.

The Olympic athlete, charged with murder in the shooting death of his girlfriend Reeva Steenkamp last month, is challenging travel restrictions and having to report twice a week to a police station, among other conditions.

Oldwadge and prosecutors said Pistorius — who hasn’t been seen publicly since he was granted bail — was not required to appear in court for the appeal.

The next part of the 26-year-old double-amputee runner’s high-profile case — which continues to grip South Africans and much of the world’s media — will now take place while brother Carl is in another court to defend himself against a culpable homicide charge for alleged negligent driving in the death of a 36-year-old woman in a road collision in 2008.

Carl was going to trial on Wednesday and Thursday in the Vanderbijlpark Magistrate’s Court, south of Johannesburg, prosecutors said. The 28-year-old Carl denies the charges and Oldwadge said he would lead Carl’s defense at the trial.

The concurrent dates for the Pistorius brothers had also stretched the family’s legal team, Oldwadge said, and provided them with significant logistical problems.

“We didn’t suggest it (the date for Oscar’s appeal) but we were forced into it because of the need to get the appeal heard as soon as possible,” Oldwadge said.

He said there was “no need” for Oscar to appear in court.

The multiple Paralympic champion’s legal team filed an appeal against some of his bail conditions on March 7, objecting to him being not allowed to travel outside of South Africa even though a magistrate said he was not a flight risk when granting him 1 million rand ($108,000) bail last month. They’re also challenging the alcohol ban and that Pistorius cannot speak with any residents at the Silverwoods Country Estate, where he shot Steenkamp dead in his house the early hours of Feb. 14.

Pistorius’ lawyers say he should be able to consult with residents to be able to prepare his defense. They also object to the ruling that he has to report twice a week to the Brooklyn Police Station in Pretoria, where he was held after his arrest.

Pistorius denies murdering his girlfriend and says he shot her by mistake fearing an intruder was in his home. Prosecutors say he killed her intentionally following a loud argument in the early hours of Valentine’s Day.

State prosecutors also believe they have a culpable homicide case against Carl, who they argue was driving negligently, National Prosecuting Authority spokesman Medupe Simasiku told the AP on Friday.

Report: Lotus bankruptcy case dismissed in UK

Times have not been easy for Lotus lately, so when its name came up on a list of companies scheduled for a liquidation court, it seemed like the end could be near for the fabled British builder of lightweight sports cars. As it turns out, Lotus was on the Companies Court Winding Up list in the UK due to a contractual dispute with a supplier, and the High Court has since dismissed the case.

According to Autocar, Lotus and the supplier actually resolved their issue earlier in the year, but the process couldn’t be stopped until seen by a judge. The report says that the case was initiated when Group Lotus failed to pay some of its debts, which is probably a fair indication that Lotus is far from out of the weeds in regards to its financial difficulties.

Zimbabwe police ignore order to free top lawyer

An independent Zimbabwean lawyers’ group says the continued detention of one of its top members, the country’s most prominent human rights attorney Beatrice Mtetwa, highlights the urgent need for reform of law enforcement, two days after a referendum on a new constitution to strengthen human rights.

Zimbabwe Lawyers for Human rights said Monday that a High Court judge, in a special overnight hearing, ordered Mtetwa’s release, but police refused to comply. Mtetwa was arrested Sunday, before dawn.

Mtetwa is charged with obstructing justice while representing four officials of the prime minister’s party, also arrested Sunday.

Irene Petras, director of the lawyers’ group, said the refusal Monday by police to free Mtetwa reinforces calls for a full overhaul of skewed policing before presidential elections later this year.

Kim Dotcom allowed to sue New Zealand spy agency

Megaupload’s Kim Dotcom will be allowed to pursue damages against New Zealand’s spy agency for illegally spying on him, the country’s Court of Appeal ruled Thursday.

The court upheld in part a High Court decision from December that added the Government Communications Security Bureau (GCSB) as a defendant in the case, which was opposed and later appealed by New Zealand’s attorney general.

Dotcom and several of his colleagues were spied on starting in December 2011 by the GCSB leading up to the January 2012 raid on his mansion outside of Auckland. The spying was later found to be illegal since Dotcom, who has German and Finnish citizenship, and Bram van der Kolk, who is Dutch, are permanent residents of New Zealand.

The GCSB is allowed to observe foreign nationals but was unaware of Dotcom and van der Kolk’s residency status. In September, New Zealand Prime Minister John Key called for an inquiry and expressed “disappointment that unlawful acts had taken place.”

Zimbabwean judge dismisses referendum postponement

A Zimbabwean lawyer says a judge dismissed a civic group’s application to postpone the country’s referendum vote on a new constitution.

Alec Muchadehama, attorney for the National Constitutional Assembly, said Thursday a High Court judge ruled the courts have “no power” to change a date set by President Robert Mugabe because “he can do whatever he wants as long as the constitution allows it.”

Mugabe announced on Feb. 8 that the referendum will be held on March 16, allowing voters only five weeks to review the 160-page draft charter.

The National Constitutional Assembly argues that is not enough time for people to read and understand such a “complex” document.

Muchadehama said he will appeal against the ruling because it “allows the president to act against the rights of citizens.”
