Military court denies Navy appeal in Iraq war case

The military’s highest court has denied a government request to reconsider the overturned murder conviction of a Marine who’s served more than half his 11-year sentence in one of the Iraq war’s biggest war crime cases.

The denial from the Court of Appeals for the Armed Forces allows for the release of Sgt. Lawrence Hutchins III from the brig at a California Marine base.

Defense attorney Maj. Babu Kaza tells U-T San Diego that Hutchins will be released Friday.

The Navy can appeal to the U.S. Supreme Court or retry Hutchins.

Last month, the appeals court found Hutchins’ rights were violated when he was held in solitary confinement and interrogated without attorney access for seven days.

Hutchins led a squad accused of kidnapping an Iraqi man and killing him in 2006.

Video: Obama’s Secret $8 Billion Bribe To The Muslim Brotherhood

According to Arabic News Channel TV14 and reported on by Egypt Daily News, Obama’s relationship with recently deposed Muslim Brotherhood President Mohammed Morsi goes far deeper than mere support as a democratically elected President.

Per TV14, Obama conducted secret negotiations with Morsi and the Muslim Brotherhood outside of normal diplomatic channels.

According to sources cited by TV14, Obama secretly transferred eight billion dollars to the Muslim Brotherhood—not the Egyptian government—as payment to guarantee that a large portion of the Sinai Peninsula be turned over to the terrorist organization Hamas, an avowed enemy of both the United States and Israel.

The secret agreement was signed by deposed Egyptian president Mohammed Morsi and his second in command, Khairat el Shater.

Who on the U.S. side signed the agreement and where Barack Obama got the eight billion dollars is not clear. When Mohammed Morsi was deposed and arrested by the Egyptian military, evidence of the secret agreement was discovered and seized.

Further, per the news segment, which has been uploaded to YouTube and has since gone viral, secret negotiations between Obama and the Egyptian military—specifically Colonel Abdul al-Sisi, head of the Armed Forces—were ongoing to ensure the agreement remained hidden. Per the secret negotiations, in exchange for Obama recognizing the Egyptian military as legitimate, Colonel al-Sisi promised to keep Obama’s illegal agreement with the Muslim Brotherhood secret. However, a source within the Egyptian military leaked Obama’s nefarious activities to TV14 and the world.

If Obama’s secret agreement with the Muslim Brotherhood is proven correct, it may spell the end for the Obama administration once and for all. Obama may have illegally siphoned off funds from the US Treasury and committed treason by attempting to turn land over to Hamas, a group that is not only an enemy to the United States, but has vowed to destroy every Jew on the face of the earth. If Obama’s nefarious plan would have been realized, Hamas’ control of the Sinai Peninsula would have put Israel in an indefensible position and would have led to a second holocaust.

If proven to be true, this would go far beyond the Constitution’s requirement of High Crimes and Misdemeanors as a basis for impeachment. It would mean treason, possible life in prison, or even the death penalty for Barack Hussein Obama.

Military court: Manning documents not its decision

The U.S. military’s highest court says it isn’t the right place for a dispute over public access to documents in the court-martial of Pfc. Bradley Manning.

The New York-based Center for Constitutional Rights had sued seeking access to documents in the ongoing case. The center was seeking timely access to transcripts, motions, court orders and other documents in the case of Manning, who is charged with giving classified information to the secret-spilling website WikiLeaks.

Three of the five judges for the United States Court of Appeals for the Armed Forces who heard the case, however, said the court doesn’t have the authority to consider the question of access. The judges suggested in a ruling Tuesday that the dispute could be heard by a civilian court.

Maryland: Setting a National Standard for Military Credentialing and Licensing Policy

Maryland’s Veterans Full Employment Act of 2013 sets a national standard for state legislation, streamlining the ability for service members, veterans, and their spouses to obtain over 70 civilian credentials and licenses.

• Supporting separating service members and veterans who seek to qualify for occupational licenses and certification based on their military education, training, and experience, including licenses in Emergency Medical Services and Advanced Medical Occupations.
o The bill requires state licensing units to accept education, training, or service completed by a military member toward the qualifications to receive a license or certification.

• Supporting separating service members and veterans who seek to obtain academic credit for their military education, training, and experience.
o The bill requires the state’s public universities to implement policies that award academic credit for military training, coursework, and education, thus reducing the time to degree as well as the cost of earning a degree or certificate.

• Supporting separating service members and military spouses who seek to transfer a current license by endorsement or obtain a temporary license when separating in a state other than the state that approved the current license.
o The bill requires state licensing units to expedite licensing for military spouses, service members, and recently-discharged veterans.

In the last 20 years, our Nation has made meaningful progress toward addressing sexual assault. Where victims were once left without recourse, laws have opened a path to safety and justice; where a culture of fear once kept violence hidden, survivors are more empowered to speak out and get help. But even today, too many women, men, and children suffer alone or in silence, burdened by shame or unsure anyone will listen. This month, we recommit to changing that tragic reality by stopping sexual assault before it starts and ensuring victims get the support they need.
Sexual violence is an affront to human dignity and a crime no matter where it occurs. While rape and sexual assault affect all communities, those at the greatest risk are children, teens, and young women. Nearly one in five women will be a victim of sexual assault during college. For some groups, the rates of violence are even higher — Native American women are more than twice as likely to experience sexual assault as the general population. Moreover, we know rape and sexual assault are consistently underreported, and that the physical and emotional trauma they leave behind can last for years.
With Vice President Joe Biden's leadership, we have made preventing sexual violence and supporting survivors a top priority. Earlier this month, I was proud to sign the Violence Against Women Reauthorization Act, which renews and strengthens the law that first made it possible for our country to address sexual assault in a comprehensive way. The Act preserves critical services like rape crisis centers, upholds protections for immigrant victims, gives State and tribal law enforcement better tools to investigate cases of rape, and breaks down barriers that keep lesbian, gay, bisexual, and transgender victims from getting help. It also expands funding for sexual assault nurse examiner programs and sexual assault response teams, helping States deliver justice for survivors and hold offenders accountable.
Just as we keep fighting sexual assault in our neighborhoods, we must also recommit to ending it in our military — because no one serving our country should be at risk of assault by a fellow service member. Where this crime does take place, it cannot be tolerated; victims must have access to support, and offenders must face the consequencesof their actions. You don’t mess with Texas. At least, that’s precisely what State Rep. Lyle Larson is saying with HB 149.

HB 149 is designed to counter the indefinite detention provisions, sections 1021 and 1022, of the 2012 National Defense Authorization Act. These sections authorize the indefinite military detention, without charge or trial, of anyone who commits a “belligerent act” or is suspected of terrorism and violate over 13 provisions of the U.S. Constitution and Bill of Rights. The law has also been condemned by retired members of the Armed Forces, a current U.S. CongressmanFederal Judge Katherine B. Forrest, conservative pundit Rush Limbaugh, and the American Civil Liberties Union.

Rep. Larson’s bill, once amended, will protect the people of Texas from indefinite military detention and extrajudicial assassination without charge or trial. However, we have to get it through Committee first.

It’s time to bring the pressure. One call, and taking 30 seconds to tell your legislator what you think, can make all the difference.

As we mark the 10th anniversary of the beginning of the Iraq war, Michelle and I join our fellow Americans in paying tribute to all who served and sacrificed in one of our nation’s longest wars. We salute the courage and resolve of more than 1.5 million service members and civilians who during multiple tours wrote one of the most extraordinary chapters in military service. We honor the memory of the nearly 4,500 Americans who made the ultimate sacrifice to give the Iraqi people an opportunity to forge their own future after many years of hardship. And we express our gratitude to our extraordinary military families who sacrificed on the home front, especially our Gold Star families who remain in our prayers.

The last of our troops left Iraq with their heads held high in 2011, and the United States continues to work with our Iraqi partners to advance our shared interest in security and peace. Here at home, our obligations to those who served endure. We must ensure that the more than 30,000 Americans wounded in Iraq receive the care and benefits they deserve and that we continue to improve treatment for traumatic brain injury and post-traumatic stress disorder. President Obama to Award Medal of Honor

On April 11, President Barack Obama will award Chaplain (Captain) Emil J. Kapaun, U.S. Army, the Medal of Honor for conspicuous gallantry.

Chaplain Kapaun will receive the Medal of Honor posthumously for his extraordinary heroism while serving with the 3d Battalion, 8th Cavalry Regiment, 1st Cavalry Division during combat operations against an armed enemy at Unsan, Korea and as a prisoner of war from November 1-2, 1950.

When Chinese Communist Forces viciously attacked friendly elements, Chaplain Kapaun calmly walked through withering enemy fire in order to provide comfort and medical aid to his comrades. When they found themselves surrounded by the enemy, the able-bodied men were ordered to evacuate. Chaplain Kapaun, fully aware of his certain capture, elected to stay behind with the wounded. As hand-to-hand combat ensued, he continued to make rounds. As enemy forces approached the American position, Chaplain Kapaun noticed an injured Chinese officer amongst the wounded and convinced him to negotiate the safe surrender of the American forces. Shortly after his capture, Chaplain Kapaun bravely pushed aside an enemy soldier preparing to execute a comrade, thus saving a life and inspiring all those present to remain and fight the enemy until captured.

Chaplain Kapaun’s nephew, Ray Kapaun, and family will join the President at the White House to commemorate his example of selfless service and sacrifice.

The Medal of Honor is awarded to a member of the Armed Forces who distinguishes themselves conspicuously by gallantry above and beyond the call of duty while:

  • engaged in an action against an enemy of the United States;

  • serving with friendly foreign forces engaged in an armed conflict against an opposing armed force in which the United States is not a belligerent party.

First Lady Michelle Obama Challenges Governors of all 50 States to Ease Service Members Transition to Civilian Work Force

Too often the talented men and women who have served our country face barriers that make it difficult to find jobs that capitalize on the skills they have gained through their military education and experience. Many service members and veterans are required to repeat education or training in order to receive industry certifications and state occupational licenses, even though much, and in some cases, all, of their military training and experience overlaps with credential requirements.

The members of our Armed Forces and their families make great sacrifices, and when their service is concluded, we owe it to our veterans and their families to help them accomplish a successful transition to the civilian labor force. That is why over the past year and a half, President Obama has taken significant action to create a “career-ready military” and streamline the transition process.

Today, First Lady Michelle Obama and Dr. Jill Biden highlighted the work that has been done across the country to change laws that require military spouses to attain new credentials when they move to a new state, and challenged the governors of all 50 states to take legislative or executive action to help our troops get the credentials they need by the end of 2015. Speaking to the National Governors Association in the State Dining Room, Mrs. Obama talked about the pressing need to take action and fulfill our responsibilities to the brave men and women who have sacrificed so much over the past decade:

Sun Tzu would love cyber warfare.  The master of the Chinese board game of Go enjoyed the idea of defeating his enemy without a battle. China is conducting cyber war on the United States. The People’s Liberation Army (PLA) have a group of highly trained hackers (Hēikè) whose sole purpose is to attack American companies in order to steal information to enhance the Chinese Military.  This hacking group is working with the full knowledge and blessing of the Communist’s Government leadership. It’s time America acknowledges that the Chinese are conducting a full-scale cyber war against the west.

The PLA “Unit 61398“ is believed to be launching cyber-attacks against the United States from a nondescript 12- story building in Shanghai. Most of the hacking is performed by the unit using the names Comment Crew or the Shanghai Group. The groups are most likely elements of Unit 61398. The actual manpower or capability of the PLA unit is unknown; but most of the cyber-attacks have been traced back to this building in a dilapidated area, a location that would certainly be preferred by hacker groups. The actual operation of the unit is considered a state secret, and the government will deny its existence; in fact, they have ridiculed such accusations.

2. Steal all military and manufacturing secrets.

Every day at the White House we receive thousands of letters from folks all across America. And at night, upstairs in my study, I read a few. About three years ago, I received a letter from a mom in West Virginia. Her son, Stephan, a Specialist in the Army, just 21 years old, had given his life in Afghanistan. She had received the condolence letter that I’d sent to her family, as I send to every family of the fallen. And she wrote me back. “Mr. President,” she said, “you wrote me a letter telling me that my son was a hero. I just wanted you to know what kind of hero he was.”

“My son was a great soldier,” she wrote. “As far back as I can remember, Stephan wanted to serve his country.” She spoke of how he “loved his brothers in B Troop.” How he “would do anything for them.” And of the brave actions that would cost Stephan his life, she wrote, “His sacrifice was driven by pure love.”

Today, we are honored to be joined by Stephan’s mother Vanessa and his father Larry. Please stand, Vanessa and Larry. (Applause.) We're joined by the families of the seven other patriots who also gave their lives that day. Can we please have them stand so we can acknowledge them as well. (Applause.) We're joined by members of Bravo Troop whose courage that day was driven by pure love. And we gather to present the Medal of Honor to one of these soldiers — Staff Sergeant Clinton L. Romesha.

Clint, this is our nation’s highest military decoration. It reflects the gratitude of our entire country. So we’re joined by members of Congress; leaders from across our Armed Forces, including Secretary of Defense Leon Panetta, Chairman of the Joint Chiefs of Staff Marty Dempsey, Army Secretary John McHugh, and Army Chief of Staff General Ray Odierno. We are especially honored to be joined by Clint’s 4th Infantry Division — “Iron Horse” — soldiers, and members of the Medal of Honor Society, who today welcome you into their ranks.

FACT SHEET: Fixing our Broken Immigration System so Everyone Plays by the Rules

America’s immigration system is broken. Too many employers game the system by hiring undocumented workers and there are 11 million people living in the shadows. Neither is good for the economy or the country.

It is time to act to fix the broken immigration system in a way that requires responsibility from everyone —both from the workers here illegally and those who hire them—and guarantees that everyone is playing by the same rules.
President Obama’s commonsense immigration reform proposal has four parts. First, continue to strengthen our borders. Second, crack down on companies that hire undocumented workers. Third, hold undocumented immigrants accountable before they can earn their citizenship; this means requiring undocumented workers to pay their taxes and a penalty, move to the back of the line, learn English, and pass background checks. Fourth, streamline the legal immigration system for families, workers, and employers.
Together we can build a fair, effective and commonsense immigration system that lives up to our heritage as a nation of laws and a nation of immigrants.
The key principles the President believes should be included in commonsense immigration reform are:
  • Continuing to Strengthen Border Security: President Obama has doubled the number of Border Patrol agents since 2004 and today border security is stronger than it has ever been. But there is more work to do. The President’s proposal gives law enforcement the tools they need to make our communities safer from crime. And by enhancing our infrastructure and technology, the President’s proposal continues to strengthen our ability to remove criminals and apprehend and prosecute national security threats.

  • Cracking Down on Employers Hiring Undocumented Workers: Our businesses should only employ people legally authorized to work in the United States. Businesses that knowingly employ undocumented workers are exploiting the system to gain an advantage over businesses that play by the rules. The President’s proposal is designed to stop these unfair hiring practices and hold these companies accountable. At the same time, this proposal gives employers who want to play by the rules a reliable way to verify that their employees are here legally.

  • Earned Citizenship: It is just not practical to deport 11 million undocumented immigrants living within our borders. The President’s proposal provides undocumented immigrants a legal way to earn citizenship that will encourage them to come out of the shadows so they can pay their taxes and play by the same rules as everyone else. Immigrants living here illegally must be held responsible for their actions by passing national security and criminal background checks, paying taxes and a penalty, going to the back of the line, and learning English before they can earn their citizenship. There will be no uncertainty about their ability to become U.S. citizens if they meet these eligibility criteria. The proposal will also stop punishing innocent young people brought to the country through no fault of their own by their parents and give them a chance to earn their citizenship more quickly if they serve in the military or pursue higher education.

  • Streamlining Legal Immigration: Our immigration system should reward anyone who is willing to work hard and play by the rules. For the sake of our economy and our security, legal immigration should be simple and efficient. The President’s proposal attracts the best minds to America by providing visas to foreign entrepreneurs looking to start businesses here and helping the most promising foreign graduate students in science and math stay in this country after graduation, rather than take their skills to other countries. The President’s proposal will also reunify families in a timely and humane manner.

Continuing to Strengthen Border Security

  • Strengthen border security and infrastructure. The President’s proposal strengthens and improves infrastructure at ports of entry, facilitates public-private partnerships aimed at increasing investment in foreign visitor processing, and continues supporting the use of technologies that help to secure the land and maritime borders of the United States.

  • Combat transnational crime. The President’s proposal creates new criminal penalties dedicated to combating transnational criminal organizations that traffic in drugs, weapons, and money, and that smuggle people across the borders. It also expands the scope of current law to allow for the forfeiture of these organizations’ criminal tools and proceeds. Through this approach, we will bolster our efforts to deprive criminal enterprises, including those operating along the Southwest border, of their infrastructure and profits.

  • Improve partnerships with border communities and law enforcement. The President’s proposal expands our ability to work with our cross-border law enforcement partners. Community trust and cooperation are keys to effective law enforcement. To this end, the U.S. Department of Homeland Security (DHS) will establish border community liaisons along the Southern and Northern borders to improve communication and collaboration with border communities, boost funding to tribal government partners to reduce illegal activity on tribal lands, and strengthen training on civil rights and civil liberties for DHS immigration officers.

  • Crack down on criminal networks engaging in passport and visa fraud and human smuggling. The President’s proposal creates tough criminal penalties for trafficking in passports and immigration documents and schemes to defraud, including those who prey on vulnerable immigrants through notario fraud. It also strengthens penalties to combat human smuggling rings.

  • Deporting Criminals. The President’s proposal expands smart enforcement efforts that target convicted criminals in federal or state correctional facilities, allowing us to remove them from the United States at the end of their sentences without re-entering our communities. At the same time, it protects those with a credible fear of returning to their home countries.

  • Streamline removal of nonimmigrant national security and public safety threats. The President’s proposal creates a streamlined administrative removal process for people who overstay their visas and have been determined to be threats to national security and public safety.

  • Improve our nation’s immigration courts. The President’s proposal invests in our immigration courts. By increasing the number of immigration judges and their staff, investing in training for court personnel, and improving access to legal information for immigrants, these reforms will improve court efficiency. It allows DHS to better focus its detention resources on public safety and national security threats by expanding alternatives to detention and reducing overall detention costs. It also provides greater protections for those least able to represent themselves.

Cracking Down on Employers Who Hire Undocumented Workers

  • Mandatory, phased-in electronic employment verification. The President’s proposal provides tools for employers to ensure a legal workforce by using federal government databases to verify that the people they hire are eligible to work in the United States. Penalties for hiring undocumented workers are significantly increased, and new penalties are established for committing fraud and identity theft. The new mandatory program ensures the privacy and confidentiality of all workers’ personal information and includes important procedural protections. Mandatory electronic employment verification would be phased in over five years with exemptions for certain small businesses.

  • Combat fraud and identity theft. The proposal also mandates a fraud‐resistant, tamper‐resistant Social Security card and requires workers to use fraud‐and tamper‐resistant documents to prove authorization to work in the United States. The proposal also seeks to establish a voluntary pilot program to evaluate new methods to authenticate identity and combat identity theft.

  • Protections for all workers. The President’s proposal protects workers against retaliation for exercising their labor rights. It increases the penalties for employers who hire undocumented workers to skirt the workplace standards that protect all workers. And it creates a “labor law enforcement fund” to help ensure that industries that employ significant numbers of immigrant workers comply with labor laws.

Pathway to Earned Citizenship

  • Create a provisional legal status. Undocumented immigrants must come forward and register, submit biometric data, pass criminal background and national security checks, and pay fees and penalties before they will be eligible for a provisional legal status. Agricultural workers and those who entered the United States as children would be eligible for the same program. Individuals must wait until the existing legal immigration backlogs are cleared before getting in line to apply for lawful permanent residency (i.e. a “green card”), and ultimately United States citizenship. Consistent with current law, people with provisional legal status will not be eligible for welfare or other federal benefits, including subsidies or tax credits under the new health care law.

  • Create strict requirements to qualify for lawful permanent resident status. Those applying for green cards must pay their taxes, pass additional criminal background and national security checks, register for Selective Service (where applicable), pay additional fees and penalties, and learn English and U.S. civics. As under current law, five years after receiving a green card, individuals will be eligible to apply for U.S. citizenship like every other legal permanent resident.

  • Earned citizenship for DREAMers. Children brought here illegally through no fault of their own by their parents will be eligible for earned citizenship. By going to college or serving honorably in the Armed Forces for at least two years, these children should be given an expedited opportunity to earn their citizenship. The President’s proposal brings these undocumented immigrants out of the shadows.

  • Create administrative and judicial review. An individual whose provisional lawful status has been revoked or denied, or whose application for adjustment has been denied, will have the opportunity to seek administrative and judicial review of those decisions.

  • Provide new resources to combat fraud. The President’s proposal authorizes funding to enable DHS, the Department of State, and other relevant federal agencies to establish fraud prevention programs that will provide training for adjudicators, allow regular audits of applications to identify patterns of fraud and abuse, and incorporate other proven fraud prevention measures.

Streamlining Legal Immigration

  • Keep Families Together. The proposal seeks to eliminate existing backlogs in the family-sponsored immigration system by recapturing unused visas and temporarily increasing annual visa numbers. The proposal also raises existing annual country caps from 7 percent to 15 percent for the family-sponsored immigration system. It also treats same-sex families as families by giving U.S. citizens and lawful permanent residents the ability to seek a visa on the basis of a permanent relationship with a same-sex partner. The proposal also revises current unlawful presence bars and provides broader discretion to waive bars in cases of hardship.

  • Cut Red Tape for Employers. The proposal also eliminates the backlog for employment-sponsored immigration by eliminating annual country caps and adding additional visas to the system. Outdated legal immigration programs are reformed to meet current and future demands by exempting certain categories from annual visa limitations.
  • Enhance travel and tourism. The Administration is committed to increasing U.S. travel and tourism by facilitating legitimate travel while maintaining our nation’s security. Consistent with the President’s Executive Order on travel and tourism, the President’s proposal securely streamlines visa and foreign visitor processing. It also strengthens law enforcement cooperation while maintaining the program’s robust counterterrorism and criminal information sharing initiatives. It facilitates more efficient travel by allowing greater flexibility to designate countries for participation in the Visa Waiver Program, which allows citizens of designated countries to visit the United States without obtaining a visa. And finally it permits the State Department to waive interview requirements for certain very low-risk visa applicants, permitting resources to be focused on higher risk applicants and creates a pilot for premium visa processing.

  • “Staple” green cards to advanced STEM diplomas. The proposal encourages foreign graduate students educated in the United States to stay here and contribute to our economy by “stapling” a green card to the diplomas of science, technology, engineering and mathematics (STEM) PhD and Master’s Degree graduates from qualified U.S. universities who have found employment in the United States. It also requires employers to pay a fee that will support education and training to grow the next generation of American workers in STEM careers.

  • Create a “startup visa” for job-creating entrepreneurs. The proposal allows foreign entrepreneurs who attract financing from U.S. investors or revenue from U.S. customers to start and grow their businesses in the United States, and to remain permanently if their companies grow further, create jobs for American workers, and strengthen our economy.

  • Expand opportunities for investor visas and U.S. economic development. The proposal permanently authorizes immigrant visa opportunities for regional center (pooled investment) programs; provides incentives for visa requestors to invest in programs that support national priorities, including economic development in rural and economically depressed regions ; adds new measures to combat fraud and national security threats; includes data collection on economic impact; and creates a pilot program for state and local government officials to promote economic development.

  • Create a new visa category for employees of federal national security science and technology laboratories. The proposal creates a new visa category for a limited number of highly-skilled and specialized immigrants to work in federal science and technology laboratories on critical national security needs after being in the United States. for two years and passing rigorous national security and criminal background checks.

  • Better addresses humanitarian concerns. The proposal streamlines immigration law to better protect vulnerable immigrants, including those who are victims of crime and domestic violence. It also better protects those fleeing persecution by eliminating the existing limitations that prevent qualified individuals from applying for asylum.

  • Encourage integration. The proposal promotes earned citizenship and efforts to integrate immigrants into their new American communities linguistically, civically, and economically.
