Skakel blames lawyer in latest Conn. murder appeal

Kennedy cousin Michael Skakel is trying to get his 2002 murder conviction overturned by arguing that his trial attorney failed to competently defend him against weak evidence, reigniting a long simmering debate over the strength of the sensational case.

A trial starts Tuesday in Rockville Superior Court in the latest appeal by Skakel, the 52-year-old nephew of Robert F. Kennedy’s widow, Ethel. Skakel is serving 20 years to life in prison for the 1975 golf club bludgeoning of his Greenwich neighbor Martha Moxley when they were 15.

Skakel, who has lost a series of appeals over the years and a bid for parole last year, is hoping to get out of prison through a writ of habeas corpus arguing he was deprived of his constitutional right to effective legal representation when Michael Sherman was his attorney.

Dorthy Moxley, the victim’s mother, said she will attend the trial. She said that there is no new evidence and that she hopes it will be the last appeal because it brings back painful memories.

“There are things that you put out of your mind and you don’t want to think about, but it all comes back,” Moxley said, her voice breaking.

Skakel’s current attorney, Hubert Santos, argues that his client’s conviction is based on two witnesses of dubious credibility who claimed Skakel confessed to the crime. He contends the verdict likely would have been different if Sherman had conducted an appropriate investigation, obtained evidence and challenged inappropriate state evidence.

Robert F. Kennedy Jr., Skakel’s cousin who is listed as a potential witness for the trial, believes Skakel should have been exonerated.

“It was a 27-year-old crime that had an army of suspects with evidence against them much more formidable than the evidence against Michael,” Kennedy said.

Prosecutors have long bristled over arguments the evidence was weak. Skakel’s conviction came after more than a dozen witnesses testified that he made incriminating statements, including three direct confessions, prosecutor Susann Gill wrote in court papers.

Sherman, who has appeared frequently on national television shows as a legal analyst and is listed as a potential witness, declined to comment on the latest appeal. He has said he did all he could to prevent Skakel’s conviction.

New York Fracking Study Results Likely Years Off

ALBANY, N.Y. (AP) — A health study cited by leading environmentalist Robert F. Kennedy Jr. as pivotal in helping persuade Gov. Andrew Cuomo to hold off on plans for limited gas drilling is likely years away from conclusions about whether the technology involved is safe, according to the project’s leaders.

With New York entering the fifth year of review of the process known as hydraulic fracturing, or fracking, growing calls to wait for the Geisinger Health System study to be finished could push a final decision back several more years, frustrating landowners and the industry that had hoped to begin tapping the gas reserve that lies below parts of the state.

Preliminary results could be released within a year.

ALBANY, N.Y. (AP) — New York Gov. Andrew Cuomo came as close as he ever has to approving fracking last month, laying out a limited drilling plan for as many as 40 gas wells before changing course to await the findings of a new study after discussions with environmentalist and former brother-in-law Robert F. Kennedy Jr., several people familiar with his thinking told The Associated Press.

The turning point, which could delay a decision for up to a year or longer, came in a series of phone calls with Kennedy. The two discussed a new health study on the hydraulic fracturing drilling method that could be thorough enough to trump all others in a debate that has split New York for five years.

“I think the issue suddenly got simple for him,” Kennedy told the AP, then went on to paraphrase Cuomo in their discussions: “‘If it’s causing health problems, I really don’t want it in New York state. And if it’s not causing health problems, we should figure out a way we can do it.'”

White House SC Celebs, enviros arrested at WH pipeline protest

WASHINGTON- Celebrities and environmental activists, including lawyer Robert F. Kennedy Jr. and civil rights leader Julian Bond, were arrested Wednesday after tying themselves to the White House gate to protest the Keystone XL oil pipeline from Canada.

Sierra Club executive director Michael Brune also was arrested — the first time in the group’s 120-year history that a club leader was arrested in an act of civil disobedience. The club’s board of directors approved the action as a sign of its opposition to the $7 billion pipeline, which would carry oil derived from tar sands in western Canada to refineries along the Texas Gulf Coast.

Activist Bill McKibben, actress Daryl Hannah and NASA climate scientist James Hansen also were arrested, along with more than 40 others. They were charged with failure to disperse and obey lawful orders, and released on $100 bond each.

The protesters are demanding that President Barack Obama reject the pipeline, which they say would carry “dirty oil” that contributes to global warming. They also worry about a spill.

Many business and labor groups support the 1,700-mile pipeline as a source of jobs and a step toward North American energy independence.

RFK Jr: JFK not killed by lone gunman

Robert F. Kennedy Jr. is convinced that a lone gunman wasn’t solely responsible for the assassination of his uncle, President John F. Kennedy, and said his father believed the Warren Commission report was a “shoddy piece of craftsmanship.”

Kennedy and his sister, Rory, spoke about their family Friday night while being interviewed in front of an audience by Charlie Rose at the Winspear Opera House in Dallas. The event comes as a year of observances begins for the 50th anniversary of the president’s death.
