Former Skakel attorney defends handling of trial

The attorney who represented Michael Skakel during his murder trial defended his handling of the case a day after the Kennedy cousin blasted his work.

Attorney Michael Sherman testified Friday in a Connecticut court, where Skakel is challenging his 2002 conviction on the grounds that he was deprived of his constitutional right to effective legal representation.

Hearst Connecticut Newspapers (http://bit.ly/Y3apei) reported that Sherman defended his work for Skakel but also testified that he still believes his former client is innocent. Testimony ended Friday; a ruling is not expected for months.

Skakel, the 52-year-old nephew of Robert F. Kennedy’s widow, Ethel Kennedy, is serving 20 years to life for the 1975 golf club bludgeoning of Martha Moxley when they were 15-year-old neighbors in Greenwich.

Pal: I told Skakel lawyer of claim others did it

A murder victim’s friend says she told Kennedy cousin Michael Skakel‘s attorney before his trial that she had heard two other men were responsible for the killing, but he told her that account didn’t appear credible.

Marjorie Walker Hauer testified Friday she told Michael Sherman about Gitano “Tony” Bryant’s claim that two other men had killed 15-year-old Martha Moxley in 1975. Skakel’s current attorneys have accused Sherman of ignoring the claim as they appeal Skakel’s conviction, saying he was deprived of his right to effective legal representation.

Skakel earlier sought a new trial based on Bryant’s claim, but a judge also rejected it as not credible.

Skakel is serving 20 years to life in prison for Moxley’s golf club bludgeoning when they were neighbors in Greenwich.

Sherman says Skakel agreed he probably shouldn’t testify. Skakel’s current attorney says he wanted to testify.

Sherman disclosed that Skakel’s ex-wife had planned a book saying she married a killer. He says he thwarted the proposed book, which he says wasn’t credible.

Sherman testified Thursday in Skakel’s appeal arguing he was deprived of effective legal representation.

Skakel trial lawyer challenged on case preparation

An attorney for Kennedy cousin Michael Skakel accused the lawyer who represented him at his murder trial of having a good time making trips around the country instead of preparing for the case.

Lawyer Michael Sherman took the stand Wednesday in Rockville Superior Court in Connecticut on the second day of Skakel’s appeal. Sherman faces accusations he failed to competently defend Skakel, who was convicted in 2002 of killing 15-year-old neighbor Martha Moxley in 1975.

Sherman says preparing for the case was his top priority. Sherman says the trips were to meet with Skakel, who was then living in Florida, and others involved in the case.

Skakel’s current attorney, Hubert Santos, says the trips were ostensibly to investigate the case but in fact Sherman was having a good time.

Skakel blames lawyer in latest Conn. murder appeal

Kennedy cousin Michael Skakel is trying to get his 2002 murder conviction overturned by arguing that his trial attorney failed to competently defend him against weak evidence, reigniting a long simmering debate over the strength of the sensational case.

A trial starts Tuesday in Rockville Superior Court in the latest appeal by Skakel, the 52-year-old nephew of Robert F. Kennedy’s widow, Ethel. Skakel is serving 20 years to life in prison for the 1975 golf club bludgeoning of his Greenwich neighbor Martha Moxley when they were 15.

Skakel, who has lost a series of appeals over the years and a bid for parole last year, is hoping to get out of prison through a writ of habeas corpus arguing he was deprived of his constitutional right to effective legal representation when Michael Sherman was his attorney.

Dorthy Moxley, the victim’s mother, said she will attend the trial. She said that there is no new evidence and that she hopes it will be the last appeal because it brings back painful memories.

“There are things that you put out of your mind and you don’t want to think about, but it all comes back,” Moxley said, her voice breaking.

Skakel’s current attorney, Hubert Santos, argues that his client’s conviction is based on two witnesses of dubious credibility who claimed Skakel confessed to the crime. He contends the verdict likely would have been different if Sherman had conducted an appropriate investigation, obtained evidence and challenged inappropriate state evidence.

Robert F. Kennedy Jr., Skakel’s cousin who is listed as a potential witness for the trial, believes Skakel should have been exonerated.

“It was a 27-year-old crime that had an army of suspects with evidence against them much more formidable than the evidence against Michael,” Kennedy said.

Prosecutors have long bristled over arguments the evidence was weak. Skakel’s conviction came after more than a dozen witnesses testified that he made incriminating statements, including three direct confessions, prosecutor Susann Gill wrote in court papers.

Sherman, who has appeared frequently on national television shows as a legal analyst and is listed as a potential witness, declined to comment on the latest appeal. He has said he did all he could to prevent Skakel’s conviction.
