Massive Evidence and Testimony Kept from Jury Will Support HPN’s Strong Appeal in Nevada Endoscopy Case

Nevadans’ Health Care Faces Major Disruptions, Cost Increases if Verdict Stands

LAS VEGAS–(BUSINESS WIRE)– Health Plan of Nevada (HPN) today issued the following statement regarding the punitive damages award in the Meyer/Brunson case that recently concluded at the Clark County Courthouse:

“The number announced today has no grounding whatsoever in reality – it represents fantasy damages, not punitive damages. We have a compelling case for appeal since the jurors were barred from hearing extensive evidence and testimony about how Dr. Desai’s covert, criminal practices were hidden from the entire community, including Health Plan of Nevada.

“For example, the jury did not hear that Dr. Desai has been criminally charged for the outbreak, that the same plaintiffs already sued and collected millions from a pharmaceutical company, that we used extensive provider credentialing and contracting policies and procedures, that Dr. Desai and others were credentialed or accredited by other HMOs, hospitals and the Accreditation Association for Ambulatory Health Care, and that during the relevant time period a number of government agencies had inspected the clinic where these providers practiced and found no issues.

“Even more troubling, the court held that placing Dr. Desai in HPN‘s network caused the plaintiffs to contract Hepatitis C because: (1) plaintiffs’ Hepatitis C was the result of Desai’s medical malpractice; and (2) a doctor’s medical malpractice is always a foreseeable consequence of placing a doctor in a health plan’s network. If allowed to stand, this would have a devastating impact on the availability and affordability of health insurance in Nevada.

“The only numbers that matter here are the higher insurance premiums that Nevadans may pay if health plans are held liable for the criminal conduct of independent doctors.”

UnitedHealthcare mascot “Dr. Health E Hound”, Mayor Lewis Rosen, and Don Langer, president of UnitedHealthcare Community Plan of Texas, kicked-off the 1-mile course and concluded through the finish line chute with local youth, including kids from the Galveston Boys & Girls Club, L.A Morgan School of Science, and Clearcreek Intermediate School.

The first event was today in Galveston where hundreds of young people, ages 3 to 15, participated in a one-mile race to raise awareness about obesity and living healthy. The company provided complimentary tickets to the race and weekend-long IRONMAN activities to local youth from under-served areas, enabling kids who often face barriers to good health, to compete in the running event.

Children from low-income and low-education households are three-times more likely to suffer from obesity, which is a leading risk factor for diabetes, heart disease and many cancers, according to America’s Health Rankings®, an annual comprehensive assessment of the nation’s health on a state-by-state basis. Texas ranks 38th in the country in childhood obesity, and more than 15% of Texas youth are estimated to be obese.

American Water Receives Safety Award from Missouri Water Environment Association

VOORHEES, N.J.–(BUSINESS WIRE)– American Water (NYS: AWK) , the nation’s largest publicly traded water utility, today announced that its Contract Services Group received the 2012 Safety Award from the Missouri Water Environment Association (MWEA). The award, which recognized American Water for the highest level of safety compliance in its operation of the City of St. Charles wastewater treatment facility, is being presented today at the MWEA annual meeting.

The Safety Award is given annually by the MWEA to facilities within the State of Missouri that have the highest level of safety compliance. This is the second year American Water has won this award for its operation of the St. Charles facility, which includes the Mississippi River and Missouri River wastewater treatment plants. The two treatment facilities consistently operated better than limits set forth in the city’s operating permit, as specified by the State of Missouri Department of Natural Resources National Pollutant Discharge Elimination System permit.
