When Is A Law, Not A Law? When Obama Says So

By Alan Caruba

Obama Obamacare Obamalaw SC When is a Law, Not a Law? When Obama Says So

Obamacare has been showing signs of being so unenforceable, so expensive, and so utterly stupid that Obama’s administration has had to engage in all manner of patently illegal waivers and delays to maintain their lies about it.

In the words of the late Chinese Communist dictator, Mao Zedong, Obamacare has been “a great leap forward” to reform healthcare in America. In China, the Great Leap killed an estimated forty million people between 1958 and 1961. There is no way of knowing how many Obamacare would kill when (and if) it is fully implemented.

Presidents are not allowed to decide what part of what laws-or any laws-they do not want to enforce. Michael W. McConnell, a professor of law and director of the Constitutional Law Center at Stanford Law School and a senior fellow at the Hoover Foundation, recently noted that “Article II, Section 3, of the Constitution states that the president ‘shall take care that the laws be faithfully executed.’ This is a duty, not a discretionary power. While the president does have substantial discretion about how to enforce a law, he has no discretion about whether to do so.”

In Clinton v. City of New York, 1998, Supreme Court Justice John Paul Stevens wrote that “There is no provision in the Constitution that authorizes the president to enact, to amend, or to repeal statutes.” MConnell cites this, saying “The employer mandate in the Affordable Care Act contains no provision allowing the president to suspend, delay or repeal it.”

Bearing in mind that Obamacare essentially authorizes the government to seize control of one sixth of the nation’s economy, not to mention intrusively getting between a physician and his patient, it is such a legislative monstrosity, so poorly conceived and written, that it has been subject to a series of desperate efforts by the Obama administration to “fix” what is essentially unfixable.

Obamacare’s effect on the economy has already been felt: slowing hiring, moving full-time employees to part-time status, causing the cost of premiums to skyrocket, and contributing to 54 months of economic stagnation. It has become a political liability to Democrats who will run for office in the 2014 midterm elections.

Just slightly more than half the States refused to set up the “exchanges” in which individuals would select their insurance plans. This has forced the federal government to set up their own, and that is not going well. In April, the administration announced that workers will not be able to choose plans from different health insurers in the small business exchanges next year.

The IRS announced it would implement the law’s tax credits, subsidies, and taxes in states with federal exchanges, even though the Act “clearly, repeatedly, consistently, and intentionally prohibits the IRS from doing so,” according to Michael Cannon of the Cato Institute. “The IRS has literally asserted the authority to tax, borrow, and spend more than $1 trillion contrary to the express will of Congress,” citing Section 4980H of the Act that requires it begin after December 31, 2013.

Congress found the Act’s long-term entitlement to …read more

Suspected Maoist rebels kill 5 in India

Police say suspected Maoist rebels have shot and killed three policemen and two private security guards in an attack on a private construction company complex in eastern India.

Suspected rebels kill 2, wound several in India

Suspected Maoist rebels on Saturday attacked a convoy of cars carrying local leaders and supporters of India‘s ruling Congress party in a Maoist-infested area in eastern India, killing at least two party members and wounding and kidnapping several others.

Senior police officer M. Gupta said suspected insurgents triggered a land mine blast and fired at the vehicles in the Sukma area, about 215 miles (345 kilometers) south of Raipur, the capital of Chhattisgarh state.

Congress party president Sonia Gandhi said two state party leaders died in what she described as a “dastardly attack” on India‘s democratic system.

Police identified one of those killed as Mahendra Karma, a Congress leader in Chhattisgarh state who founded a local militia, the Salwa Judum, to combat the Maoist rebels. The anti-rebel militia had to be reined in after it was accused of atrocities against tribals — indigenous people at the bottom of India‘s rigid social ladder.

The wounded Congress party members, among them Vidya Charan Shukla, a former federal minister, were taken to a local hospital, police said.

The Press Trust of India news agency said the suspected rebels also took away a local party leader, Nand Kumar Patel, and his son.

PTI said the attackers blocked the road by felling trees and triggered a land mine blast that blew up one of the cars in the convoy. The attackers fired at the Congress party leaders and their supporters and then fled.

The Congress party is the main opposition party in the state.

The rebels, known as Naxalites, have been fighting the central government for more than four decades, demanding land and jobs for tenant farmers and the poor. They take their name from the West Bengal village of Naxalbari where the movement began in 1967. The fighters were inspired by Chinese Communist revolutionary leader Mao Zedong and have drawn support from displaced tribal populations opposed to corporate exploitation and official corruption.

Prime Minister Manmohan Singh has called the rebels India‘s biggest internal security threat. They are now present in 20 of India‘s 28 states and have thousands of fighters, according to the Home Ministry.

Shanghai bishop Jin Luxian dies at age 97

Shanghai Bishop Aloyisius Jin Luxian, who revived the Catholic church in China‘s financial hub after years of Maoist persecution, has died. He was 97.

Ordained in 1938, Jin was imprisoned for nearly two decades under communist China‘s founder Mao Zedong, who ordered Chinese Catholics to cut their ties with the Vatican.

Jin was formally released in 1982 and named Shanghai bishop in 1988 by the Communist Party controlled Patriotic Catholic Association. Although the Vatican recognized another priest as Shanghai bishop, Jin worked tirelessly to recover church property and rebuild congregations.

Jin’s anointed successor, Thaddeus Ma Daqin, was placed under house arrest at Shanghai’s Sheshan Seminary last year after renouncing his membership in the Patriotic Association, enraging communist officials who maintain tight controls on religion.

Jin died Saturday.

If There Is No God – Part II

By Anthony ‘AC’ Castellitto

(Editor’s note: Read Part 1 here.)

Ultimately, if religion is merely a creation of man, and religion itself is evil, what does that say about man? And why has God all of a sudden become expendable? He has always had a prominent place in our hearts and in our society. God wasn’t a problem for two centuries; but now the Democratic Party has gone agnostic, and the Republican party is split.

Let’s say, hypothetically, that the GOP excommunicates God (and the Republican secularists lose their ‘Scapegoat’) – what’s the platform? What makes the GOP a winning ticket?

Whether man wants to hide behind religion, big government, progressivism, or secularism – we’re imploding! As far as ideology goes, no matter what our espoused affiliation, we’ve all contributed to the mess. None of us are innocent – there’s plenty of blame to go around!

In the end, we must blame the depraved, morally bankrupt, self-destructive tendencies of MAN for our demise. Atheists who claim that man is responsible for creating religion are forced to come to the same conclusion.

The Constitution may have proven to be an essential tool in keeping religious tyranny from reigning. But we’re swiftly headed in the other direction towards Communism, which is a religion in and of itself, in which the government is our god (and applies complete control over us).

Religion should not be used as a means of control; it should serve a greater purpose. I never considered Emperor Constantine (or any other political-religious leader for that matter) having pure intentions – but at least he stopped the persecution of Christians.

Absolute power and authority in the hands of men is bad, no matter the ideology/affiliation. The Christians I know don’t want theocracy, despite the obnoxious claims perpetuated by the New Atheists.

In fact, I pointedly asked Dave:

“Why the bias, the law suits, and the hard cultural atheism? This is a new phenomenon!”

To Dave’s credit, he took a sincere stab at addressing the question:

I think the vitriol came initially after the war on terror and the atrocities – largely from Muslims – that occurred . However they (atheists) were uncomfortable associating with Christians who were also appalled by the jihadists. I think you saw people like Richard Dawkins and Bill Maher tending to be more critical of Christians (Christians don’t threaten to cut off your head, at least not anymore) because it was an easier target- other atheists used it as an opportunity to point out the hypocrisy they saw in all religions . Truthfully, many atheists now see religion on the decline and want to speed it’s demise.

In response, I affirmed that demise of religion will not fix the problem! This is not a religion problem but a human nature problem. Take away religion, and you still have the man.

If you look at the atrocities perpetuated in heathen lands and godless, secular societies led by cruel dictators (i.e. Stalin, Hitler, Mao Zedong, Pol Pot, etc.) throughout history, the root of the evil is apparent!

Darwinism, in particular, has had a

Docs signed by Mao sold for millions

By hnn

Two secret documents signed by China’s Mao Zedong during the 1930s sold for almost a million dollars at a New York auction on Wednesday, reported the state-run news agency China News Service.

The rare documents are related to the famous 1936 Xi’an Incident, a turning point in Chinese history when one of Chiang Kai-shek’s most trusted generals, the “Young Marshal” Zhang Xueliang, placed him under house arrest — forcing the leader of the nationalist Chinese Republic of China to negotiate a cease-fire with Mao’s Communists, in order to fight a joint war against the Japanese invasion….

Obamaism: Leftist Religiosity

Obama Saves 2 SC Obamaism: Leftist Religiosity

Obama isn’t the mere beneficiary of a national, secular cult of personality, like Stalin or China’s Mao Zedong.

That’s for his more rational liberal lemmings. Their high water mark ends with him being the so-called greatest political leader of all time, which is bad enough.

In American socialism’s servant quarters, American Blacks embraced him full bore with the fervor of our African emotionalism and declared him a ” savior.”

Centuries of acculturation apparently haven’t dimmed this primal urge to declare demi-gods, even in a post-modern era.

A statist-sanctioned religiosity (I won’t dignify it with the term “religion”) has spread like wildfire before traditional Americans’ eyes.

Despite socialism being an atheist doctrine, it will use religion (what Marx denounced as the “opium of the people”) to whip spiritual proletarians into a frenzy.

The leftist religiosity that is Obamaism is the linear result of Black Liberation Theology, taken to the nth degree.

Their dream has come true; and against all odds, a Black demi-god rules America. His bi-racial heritage lures guilty Whites into the fold and completes the multicultural mosaic, along with Latinos and, more recently, homosexuals.

Tribal Blacks, my shorthand for Obama’s American Black “church”, sacrilegiously feel that biblical prophesy has been fulfilled. In Obamaism, they lose themselves in the ecstatic moment, without fretting over glaring indifference, epidemic unemployment, homelessness, and Black middle class annihilation.

This leftist religiosity not only casts morally bankrupt Democrats as de facto apostles, but also threatens a line of succession the likes of which America has never seen.

Obamaism is what happens when socialists masterfully manipulate insecure people and religiosity to craft a demi-god as placebo for what ails their followers.

They’re better served remembering the words of Thomas Jefferson, who said:

“I tremble for my country when I reflect that God is just, that His justice cannot sleep forever.”
