Testimony resumes in Arias death penalty trial

Testimony resumes in Jodi Arias‘ death penalty trial after an expert explained last week how she suffers from post-traumatic stress disorder and memory loss since killing her lover in Arizona.

Arias is charged with first-degree murder in the June 2008 death of Travis Alexander in his suburban Phoenix home.

Authorities say she planned the attack. Arias initially told authorities she had nothing to do with it then blamed it on masked intruders. Two years after her arrest, she said it was self-defense.

Psychologist Richard Samuels, a defense witness, was set to resume testimony Monday. Arguments were set to determine whether the judge would allow Samuels to testify if the killing appeared premeditated based on interviews with Arias and a review of crime scene photos.

Arias concluded her 18th day of testimony last week. On Thursday the defense called their next witness, mental health expert Richard Samuels.

Samuels testified about Arias’ mental state before and after the June 2008 shooting, stabbing and slashing of Travis Alexander. Arias, 32, is charged with first-degree murder and faces the death penalty if convicted.

Video shows Jodi Arias singing, performing headstand minutes before murder charge

Minutes before Jodi Arias was charged with the brutal murder of her boyfriend, she was caught on video singing, laughing, asking about her makeup and doing a 20-second headstand.

The June 15, 2008, video catches her just 15 minutes after sobbing through a four-hour police interrogation. Her attitude dramatically changes.

Once the prosecutor leaves the room Arias is seen talking to herself, laughing and playing with a garbage can. She then does a headstand against the wall.

Arias, who testified for 18 days over nearly six weeks, has cited self defense, masked intruders and memory loss in justifying the 2008 killing of her boyfriend, Travis Alexander.

A psychologist testified Thursday that jurors should see Arias’ unusual behavior in context.

“A large percentage of individuals who are in such settings do not remember or have cloudy or foggy memories of what has transpired,” Richard Samuels testified. “We are more concerned with survival.”

Samuels said he specializes in “sexually violent perpetrator evaluations, psychosexual risk assessments, sexual harassment and gender discrimination matters.”

He said he has met with Arias a dozen times and eventually diagnosed her with post-traumatic stress disorder.

“There are many people that never remember the actual events,” Samuels said.

In the 2008 video, Arias is heard singing a song with the lyrics, “it might change my memory.”

Arias initially told authorities she had nothing to do with the murder, but her defense now argues the killing was in self defense. During testimony, Arias has described an abusive childhood, cheating boyfriends, dead-end jobs and a shocking sexual relationship with Alexander, and she contends he had grown physically abusive in the months leading up to his death, once even choking her into unconsciousness.

Samuels testified that Arias lied initially about her involvement because she was in denial “where a person cannot deal with the fact that something they did is so opposite from everything else in their life.”

Alexander suffered nearly 30 knife wounds, was shot in the head and had his throat slit before prosecutors say Arias dragged his body into the shower.

Arias testified she remembered Alexander attacking her and that she ran into his closet, retrieved a gun he kept on a shelf and fired in self-defense. She has testified that she has no memory of the stabbings.

Arias’ grandparents had reported a .25-caliber handgun stolen from their Northern California home about a week before the murder – the same caliber used to shoot him – but Arias said she didn’t take it. Authorities think she took it with her.

Arias has acknowledged trying to clean the murder scene, dumping the gun in the desert and leaving Alexander a voicemail on his cellphone hours later in an attempt to avoid suspicion. She said she was scared to tell the truth.

No witnesses have been able to confirm Arias allegations about Alexander’s violence, gun ownership and sexual desire for young boys.

She has acknowledged lying repeatedly but insists to jurors that she is telling the truth now.

The trial is set to resume Monday. She could get the death penalty if convicted.

Jodi Arias, the Arizona woman on trial for the brutal murder of her ex-boyfriend, was depressed and in denial after the gruesome slaying, a psychologist told a jury in Phoenix Thursday.

Defense expert Richard Samuels testified at Arias’ trial about her mental state before and after the June 2008 shooting, stabbing and slashing of Travis Alexander. Arias, 32, is charged with first-degree murder and faces the death penalty if convicted.

“She was not able to tell her family about what happened,” Samuels said. “She was not able to tell anybody about what happened. And this is a classic symptom of an acute stress disorder.”

Arias questioned over self-proclaimed memory loss, repeated lies as day 30 of trial ends

Jodi Arias has concluded her testimony after 18 days on the witness stand in her Arizona death penalty trial.

She’s charged with first-degree murder in the June 2008 death of Travis Alexander in his suburban Phoenix home. Authorities say she planned the attack on her lover in a jealous rage. Arias says it was self-defense.

Prosecutor Juan Martinez spent much of the day Wednesday questioning Arias over repeated lies in the case and her self-proclaimed memory lapses from the day of the killing.

Jurors also had about 10 additional questions for Arias. Last week, the panel posed about 220 questions and made it clear they aren’t satisfied with her explanations. Arizona law allows jurors to quiz defendants through written questions read aloud by the judge.

Fingerprint Records Clear Travis Alexander’s Name

Authorities in California have confirmed Travis Alexander, the man Jodi Arias is charged with murdering, was the victim of an identity theft that resulted in a mistaken criminal record.

“We were able to confirm via fingerprints that the person in [the police report] is not Travis. It is Dennis Alexander … [The] booking photo is of Dennis, using Travis’ name,” Sgt. Lisa McConnell, of the Riverside County Sheriff’s Department, told The Huffington Post Tuesday evening.

On Monday, HuffPost reported that court documents in Travis Alexander’s name show an arrest and conviction for fighting with a security guard and shoplifting in Riverside, Calif., in 2002. Arias supporters had also obtained copies of the court documents and were posting the information online, in an apparent attempt to show that Alexander was prone to violent outbursts, as Arias alleged in court earlier this month.

Travis Alexander Arrest Record Questioned; Police Checking If Brother Was Actually In Custody

Authorities in California are scrambling to determine who they actually had in custody following a theft and battery arrest that court documents attribute to Travis Alexander, the ex-boyfriend Jodi Arias is charged with murdering.

On Monday, The Huffington Post reported that Alexander’s record shows a previously undisclosed conviction for fighting with a security guard and shoplifting in Riverside in 2002. But his brother Dennis Alexander immediately claimed that he was the actual culprit.

“We’re glad [The Huffington Post] brought it to our attention. We’re trying to verify if that’s him or not,” deputy Alberto Martinez, of the Riverside County Sheriff’s Department, told HuffPost Tuesday afternoon.

Jury awaits answer to key question in Arias murder trial: Why should we believe you?

After more than 200 questions last week, it’s now apparent that some of the 18 jurors (6 will become alternates) in the Jodi Arias murder trial are not buying her story. And they have submitted more questions, which will be asked after prosecutor Juan Martinez wraps up his latest round of questioning with Arias when the trial resumes Wednesday.

Defense attorney Kirk Nurmi tried repairing the holes in Arias’ story after the prosecutor and jurors tore it up. But there is one juror question that lingers: After all the lies you told, why should we believe you now?

Nurmi even called it “the ultimate question” and ended on Thursday by asking Arias one more time: Why should jurors believe you? It was a remarkable moment, as the defendant had one more chance to explain why she should be trusted after all her lies and coverups.

She began by repeating what she has said numerous times in this trial: She didn’t want people to find out just how bad of a person Travis Alexander was, so she lied to protect his reputation. But her answer ended with some words that shed light on her defense team’s next steps:

“If I’m convicted, that’s because of my own bad choices.”

Once Arias leaves the stand (nobody can say for sure when that will be, but we’re getting close) the defense will call at least two expert witnesses — psychologists hired by the Arias defense team.

In documents filed with the court, the defense says one of these witnesses “will testify regarding the abusive nature of the relationship between Ms. Arias and Mr. Alexander in an effort to help the jury understand the reasonable person assessment they must make….”

These witnesses must explain why a woman would make such bad choices — before, on and after June 4, 2008.

Why would she continue sleeping with a pedophile, an abusive sexual deviant? Why would a woman who killed in self-defense attempt to clean up the scene, take the gun and not call 911? And why would this same woman lie over and over again about killing a man, if it were truly in self-defense?

These are questions the defense hopes to answer in the coming days. They are questions that some jurors apparently want answered, too.

Waiting in the wings is Alyce LaViolette, a domestic abuse expert and experienced expert witness in criminal trials. Her resume lists nearly 30 appearances as an expert witness, dating back to 1984 when she was involved in a first-degree murder case involving “a battered woman who allegedly killed her husband.”

LaViolette wrote a book about domestic abuse in 2000. More recently, she gave a speech called, “Why Do People Hurt the Ones They Love?” at a 2011 conference for military families that focused on domestic abuse and post-traumatic stress disorder.

PTSD is expected to be a major explanation for Arias’ behavior and LaViolette has plenty of experience talking about it. This will likely be the main factor in explaining Arias’ blackout or “fog” on June 4, 2008, as well as explaining …read more

UPDATE: According to Jane Velez-Mitchell, Travis Alexander spoke of being a victim of identity fraud when he worked as a motivational speaker.

However, Alexander’s brother, Dennis Alexander, says he was the one who actually committed the crime.

Jodi Arias has spent two weeks on the witness stand answering detailed questions from attorneys about practically every aspect of her life including the day she killed her lover and the painstaking steps she took to cover her tracks. Now it’s the jury’s turn.

Arias is charged with first-degree murder in the June 2008 killing of Travis Alexander in his suburban Phoenix home. She says it was self-defense when he attacked her after a day of raunchy sex, but police say she planned it in a jealous rage.

Arias initially told authorities she had nothing to do with Alexander’s death then blamed it on masked intruders before settling on self-defense. Her repeated lies to authorities, friends and family in the days after his death, and her methodical efforts to create an alibi and avoid suspicion have been center stage throughout the weekslong trial as she explained how she remembers little from the day of the killing.

Alexander had been shot in the head, stabbed and slashed nearly 30 times and had his throat slit.

After a withering cross-examination last week, and her attorneys’ efforts to portray the victim as an abusive womanizer, in part, hoping to spare Arias the death penalty, jurors on Wednesday will pose their own questions to the defendant, something allowed in Arizona criminal cases.

Judge Sherry Stephens told attorneys Tuesday the panel has about 100 questions for Arias. The prosecutor and her attorneys will gather Wednesday morning to review the written queries and submit any objections, then Stephens will pose them to Arias directly.

Throughout her testimony, Arias has described an abusive childhood at the hands of her parents, a past littered with cheating boyfriends and dead-end jobs, and the minutia of car problems, cooking and converting to Mormonism. She has also detailed for jurors how Alexander grew physically abusive in the months leading up to his death, once choking her into unconsciousness, and how he had sexual desires for young boys.

However, none of her allegations have been corroborated by witnesses or evidence during the trial, and she has admitted to lying repeatedly prior to and after her arrest, but Arias insists she is telling the truth now.

She has acknowledged she dumped the gun in the desert, got rid of her bloody clothes, tried to clean the scene at Alexander’s home, and even left the victim a voicemail on his mobile phone within hours of killing him and dragging his body into the shower. Arias returns to witness stand in murder trial

Testimony in the case of a woman accused of killing her lover turned into a one-sided shouting match Tuesday between Jodi Arias and a prosecutor grilling her over memory problems, with Arias saying his aggressive demeanor and posture was causing her to forget crucial details or provide concise answers.

“I’m not having a problem telling the truth,” Arias softly told prosecutor Juan Martinez, who stammered with his response, his voice growing louder.

“But you are having a problem answering my questions, right?” Martinez snapped back.

In stark contrast to her testimony under questioning by her own lawyers, during which she alternated between poise and tears and recalled precise details of practically her entire life dating back years, Arias recalls virtually nothing under questioning by Martinez.

She often responds to his questions by saying, “Sure,” to which Martinez loudly snaps backs that he is merely looking for a yes or no answer.

The barbs have led to numerous private conferences between attorneys and the judge as defense lawyers repeatedly object to Martinez’s aggressiveness, accusing him of badgering the witness.

Later Tuesday, Martinez focused on how Arias had broken up with previous boyfriends who she learned had cheated on her, as she says she did with Travis Alexander, yet has testified during the trial how Alexander had complete control over her.

“So when you decide something, you can do it right?” Martinez asked.

“Yes,” Arias replied.

Arias is charged in the June 2008 death of her lover in his suburban Phoenix home. She says she dated Alexander for about five months before breaking up with him but continued to see him for sex up until the day she killed him. She says she was forced to fight for her life after Alexander attacked her, but police say she planned the attack in a jealous rage. Testimony began in early January.
