Libya urged to give ex-spy chief access to lawyer

An international rights group is urging Libyan authorities to give an ex-spy chief indicted for alleged crimes against humanity access to a lawyer.

The New York-based Human Rights Watch said in a statement on Wednesday that its team visited Abdullah al-Senoussi in prison earlier this month and that he did not complain of any physical mistreatment in prison, but said he didn’t have a lawyer.

Al-Senoussi was indicted by The International Criminal Court in June 2011 for crimes against humanity during brutal attempts to put down the Libyan rebellion that ousted dictator Moammar Gadhafi after four decades in power.

Sarah Leah Whitson of Human Rights Watch says al-Senoussi needs to be granted the rights the Gadhafi regime long denied to the Libyan people.

Libya says it should be allowed to try spy chief

Libya has formally applied to the International Criminal Court to be allowed to put Moammar Gadhafi‘s former spy chief on trial in Tripoli instead of sending him to The Hague to face justice.

In a lengthy submission published Wednesday, lawyers representing Libya argue that Abdullah al-Senoussi’s home country is willing and able to prosecute him and therefore has precedence over the world’s first permanent war crimes tribunal.

The International Criminal Court has indicted Al-Senoussi for crimes against humanity allegedly committed during the Gadhafi regime’s brutal attempts to put down the 2011 rebellion that ousted the dictator after four decades in power.

Al-Senoussi is jailed in Libya. His lawyers argue he will not get a fair trial at home and should be sent to The Hague.

ICC orders Libya to hand over intelligence chief

Judges at the International Criminal Court have ordered Libyan authorities to immediately surrender slain dictator Moammar Gadhafi‘s former intelligence chief Abdullah al-Senoussi.

The written order published Thursday sets up the latest legal showdown between the Hague-based court and Libyan authorities who say they plan to put Al-Senoussi on trial themselves.

The ICC has indicted Al-Senoussi on crimes against humanity charges for the murder and persecution of protesters in the early days of the uprising that eventually toppled Gadhafi in 2011.

Libyan authorities also are holding Gadhafi’s son and one-time heir-apparent, Seif al-Islam Gadhafi, who also is wanted by the court.

Libya denies Gadhafi, Al-Senoussi trials imminent

Libyan authorities say the trials of one of Moammar Gadhafi‘s sons and the slain dictator’s former spy chief are not scheduled to start next month, after all.

Lawyers for Libya‘s new rulers say in a letter sent to the International Criminal Court Tuesday that investigations into Seif al-Islam Gadhafi and Abdullah al-Senoussi are close to completion and pretrial proceedings will likely begin in February. The letter came after the court asked Libya to explain reports that their trial was set for February.

The court has indicted Seif al-Islam and Al-Senoussi on crimes against humanity charges stemming from Gadhafi’s brutal crackdown on the 2011 rebellion that eventually toppled his four-decade dictatorship.

However, Libya has said it wants to try both men instead of sending them to The Hague to face justice.

ICC seeks info from Libya on Gadhafi trial

The International Criminal Court asked Libyan authorities Thursday to explain widespread reports that they plan to put one of Moammar Gadhafi‘s sons and the slain dictator’s former spy chief on trial next month.

The request was the latest move in a long-running legal saga over where Seif al-Islam Gadhafi and Abdullah al-Senoussi will stand trial — at the world’s first permanent international war crimes tribunal in The Hague or in their home country.

Both men have been indicted by the ICC on crimes against humanity charges for allegedly targeting civilians in brutal attempts to put down the 2011 rebellion that toppled Moammar Gadhafi‘s four-decade dictatorship. But both Seif al-Islam Gadhafi and Al-Senoussi remain in custody in Libya.

ICC judges preparing for their possible trial in The Hague asked Libyan justice officials to explain their plans following reports earlier this month which said the men’s trials are scheduled to start in February. The request also came a day after Ben Emmerson, a British lawyer representing Al-Senoussi, asked the court to order Libya to suspend “the commencement of any trial proceedings in the national courts.”

Emmerson said Libya has an international legal obligation to turn over Al-Senoussi to the ICC based on a United Nations Security Council resolution. He also warned that his client’s trial in Libya would “inevitably constitute a flagrant denial of justice, and may result in the imposition and carrying into effect of the death penalty.”

The Libyan government has asked the Hague-based court for approval to put Seif al-Islam on trial in Libya, but has not made such a request since taking Al-Senoussi into custody last year.

The ICC is a court of last resort, meaning it takes over cases from nations unwilling or unable to put suspects on trial. Human rights groups have cast doubt on the Libyan judicial system’s ability to give former members of the Gadhafi regime a fair trial.

Libya is not a member of the ICC, however it is legally bound to cooperate with it because the Security Council ordered the court to open an investigation in Libya.

Moammar Gadhafi also was indicted by the court in 2011 for crimes against humanity, but the case was dropped after he was killed by rebels as his regime crumbled.
