International court: Libya must hand over Seif

The International Criminal Court has told Libya it has to hand over the son and one-time heir-apparent of ousted dictator Moammar Gadhafi so he can face charges of crimes against humanity.

Judges on Thursday rejected Libya’s request to suspend an earlier order to Tripoli to hand over Seif al-Islam Gadhafi, who is expected to stand trial in Libya next month.

Libya had asked for the order to be suspended pending the outcome of the new government’s appeal against the admissibility of the case at the Hague-based court.

Libya argues Seif al-Islam should be tried at home, but judges and the suspect’s lawyers have cast doubt on the country’s ability to give him a fair trial.

The international court says Libya is “currently obliged to surrender Mr. Gadhafi to the court.”

ICC orders Libya to hand over intelligence chief

Judges at the International Criminal Court have ordered Libyan authorities to immediately surrender slain dictator Moammar Gadhafi‘s former intelligence chief Abdullah al-Senoussi.

The written order published Thursday sets up the latest legal showdown between the Hague-based court and Libyan authorities who say they plan to put Al-Senoussi on trial themselves.

The ICC has indicted Al-Senoussi on crimes against humanity charges for the murder and persecution of protesters in the early days of the uprising that eventually toppled Gadhafi in 2011.

Libyan authorities also are holding Gadhafi’s son and one-time heir-apparent, Seif al-Islam Gadhafi, who also is wanted by the court.

Moammar Gadhafi's son appears in Libyan court

Libya’s official news agency says the imprisoned son of slain dictator Moammar Gadhafi has made his first appearance in a local court on charges of harming state security, attempting to escape prison and insulting the nation’s new flag.

LANA says Thursday’s trial of Seif al-Islam Gadhafi, the ousted leader’s longtime heir apparent, was held in the western town of Zintan where he is being held by militiamen. LANA says the trial is linked to his June meeting with an International Criminal Court delegation accused of smuggling documents to him.

The delegation included a lawyer assigned by ICC to represent Seif al-Islam in a separate case in which he is charged with crimes against humanity during 2011 popular uprising against his father’s four-decade rule.

The trial was adjourned until May.
